Copyright infringement from Lego

by Seller_DNl5ZtRZcMOLY

Today i received the following email from Amazon. It is a copyright infringement letter regarding a list of products. However, after going through every single item listed - none of them are products i have listed or created listing pages for, sold in the past or ever even scene before.

I do sell Lego and Lego figures but they are genuine Lego (i am also a Lego collector) and i would never sell any of these items.

The only reason i can think i have been sent this is because somebody has been altering old listing pages that used to be for Lego items and have changed them to fake products.

Anyone else had this message or had to deal with this kind of thing before?

Hello,

We are contacting you because we received a report of copyright infringement from the rights owner listed below. Sellers on Amazon.co.uk are not allowed to create listings or detail pages that infringe copyright.

We removed the content listed at the end of this email. We may let you list this content again if we receive a retraction of the complaint from the rights owner. Their contact information can be found below.

brandprotection@mm.lego.com

If the rights owner agrees to retract their complaint, they must send the retraction to us at notice-dispute@amazon.co.uk.

If you believe that the reported content does not infringe the rights owner’s copyright, you may email notice-dispute@amazon.co.uk with supporting information, if appropriate.

If the rights owner does not retract their complaint, or you do not provide supporting information, we may provide your contact information to the rights owner upon their request.

We consider allegations of intellectual property infringement a serious matter and your account is under review. If we receive more complaints about your listings, we may not allow you to sell on Amazon.co.uk.

You said you do sell some Lego items - do you have their permission to sell these ie are you an authorised re-seller of Lego? Big brands are getting very protective over who can sell their products now (even pre-owned ones).

Hello The_Brick_Loft1

I received the same messages today, with the same ASINs. I am also an official Lego reseller and do not sell any of these products.

There is actually one ASIN that is Lego: B00AU826ZO.

You can still see the product on other Amazon pages (Amazon.de e.g.) I did sell those in the past yes, but it is real Lego. Maybe, you did, too? I don’t know why this is a copyright issue.

I hope we will find a fast and good solution with Amazon/Lego.

Alex

And I did the same. Thank you for creating this thread, I am sure there are more sellers of Lego that have the same problem and now can get a clue how to proceed in this case.

I did also mention that the minifigure is part of the Set 75002 from 2013.

This sounds like something that should really be escalated higher with Amazon. You can’t seriously believe an entry level Amazon agent is going to take a huge risk by allowing products that have been flagged by another huge corporation for copyright infringement because you have an Amazon invoice. I wouldn’t! However, if you were to escalate this to someone higher up the chain, they are paid to make the educated decision that this is not infringement with an article like that and reopen the listings.
