Intellectual Property Complaints

i have today received 2 of them completely different titles and never had this before

it was only by chance i was checking my account heath and noticed 2 items blocked

it says to read the notification for more info but i have not received any

no one else had listed so i dont think its a competitor an the listings was created by myself so i know its not the images as they are freely genetic available everywhere

i clicked on the appeal button as unsure what to do ?

i sent invoices from my suppliers showing they are authentic items

i have also deleted the listing from my inventory as i seen before on the forums this is the best thing to do

and said in the appeal i have deleted them and will no longer sale these items

just worried if this will affect my account for selling which i have run for 4 years and everythings all 100% with no previous problems

Intellectual Property complaints will disappear from your Account Health page after 180 days.

But if you don’t successfully appeal and just delete the ASINs from your inventory, you have no guarantee that you won’t get suspended (and this can happen anytime - in a week or month after receipt of the notices).

The only way how to appeal would be contacting the rights owner and making him retract the complaint and then writing a good Plan of Action and e-mailing it to notice-dispute@amazon.co.uk accompanied with invoices.

hi, read the messages from Amazon again. It should show who made the complaints. That should give you more info. Amazon do not go looking. Someone must have complained. Good luck.

Had the same thing happen to me, two items removed on 9th oct no email and nothing in notifications.
So no way of knowing who made the complaint .One was a mug which have been on amazon for about 4years the orther was 4 placemats both by lesser & Pavey, cant see them making the complaint

What email was provided in the Intellectual property notice? This will give an indication as to whether it is a genuine claim or a competitor using a generic email address.

We had one for the first time ever in October and it was a Club Green product, which are widely available to purchase with wholesalers. I have appealed the decision but heard nothing back, Really don’t understand how this works, does sending invoices help as this is what I did. Nothing back from Amazon yet.

We have had 2 in the last few weeks, seems to a trend. Both items were generic and we had been selling on the listings for years, the Barcode tallied up with a suppliers we deal with so dont really see how its allowed to happen.

Moving forward i think we will just stick to selling our own branded items :slight_smile:

Sending Invoices proves authenticity but unless you receive a retraction notice from the rights holder the infringement notice stays on the account for 180 days. These infringement notices are not always genuine rights holders , some are competitors some are Intellectual property licence protection companies that agressively go after infringements on behalf of the rights holder. The email the notice states is important from this perspective.

Lesser and Pavey and specifically the Leonardo collection have recently been heavily policed with a number of Seller reporting infringement notices, this said the product being sold should be genuine from an authorised channel.

Do Amazon come back to you to discuss the matter further once an appeal is logged. I know the company mentioned is a supplier in the party industry, after investigating they seem to have a brand with the same logo as Club Green. I know that sellers of the Club Green item will be unaware (as was I ) as the items are widely available with wholesalers.

What should be the next course of action, do I contact the company concerned and what would I say. I have no idea whether or not the hold the rights to the Oh Baby range of items or whether Club Green have a right. We had sold the only item we had and Amazon have now blocked the listing. There are other items in the range which are still listed and other sellers are selling these items too. Do I remove these items from sale? It’s getting to be a minefield !!
