Using US registered TM and BR 2.0 in UK

Hello,
My friend has a TM and BR 2.0 in the USA incl EBC listings and so on.He wants me to sell his products in Europe.Can I use his TM on my account in Europe? How can I apply for this and what other credentials should I provide?

No, a US trademark is not valid/enforceable in the UK/Europe. The items will need separately TM registering as appropriate.

Amazon only recognise REGISTERED trademarks, so in case of brand registry so you would need to apply for it via the IPO (for UK only) or the EUIPO which covers European Union.

® – Signifies a registered trademark. The ® symbol may only be used on a trademark that has been examined, approved and registered with the UK Intellectual Property Office (UKIPO) or relevant IPO.

However, I have seen several sellers using a registered trademark symbol on their listings and names which of course is a violation yet Amazon do nothing about it and the IPO are not able to enforce that issue.

If you wish to use TM then of course its fine to use but it would not be accepted by Amazon if you wish to be brand registered.

The abbreviation ‘TM’ is used in the UK to indicate that a company/business is using something – be it a word, symbol or combination of the two – as a trade mark but it is currently unregistered.

You can sell USA items (as long as legal) in the UK.

Eg you can sell say a brand called: ABCD USA Clothing, but then so can anyone else sell that brand if they want.

You will not be the Brand owner.

Others though can then copy and use that brand on other items in the UK/EU, even ifg also clothing, unless the brand owner also trade marks them in UK/EU
