These Amazon Shipping Terms and Conditions ("Conditions") set out the basis on which Amazon Services Europe Sarl and/or their affiliates ("Amazon") provide parcel delivery services. The Conditions incorporate the Amazon Shipping Shipment Policy ("Policy") which set out the shipping requirements that must be complied with, and together with the Conditions are referred to as the "Terms".
References to "we" or "us" in these Terms are to Amazon and references to "you" in these Terms are to purchasers of parcel delivery services. References to "Shipment" and/or "Shipments" in these Terms shall mean the single package or parcel given to us for delivery and references to "Shipping Label" in these Terms shall mean the label printed which records the ship method delivery selected and delivery details and which you have affixed to your parcel or package.
You will be charged for Shipments in accordance with the fees and charges set out on Amazon Seller Central ("Fees"). The Fees will be automatically deducted from your Amazon Seller Central account upon receipt of the Shipment by Amazon for delivery. Should any additional sums be due to us under these Terms, we have the right to settle such sums directly from your Amazon Seller Central account.
As between the parties, you will be responsible for the collection and payment of any and all of your taxes together with the filing of all relevant returns, such as VAT and Intrastat returns and issuing VAT invoices/credit memos where required. Amazon is not responsible for collecting, remitting or reporting any VAT or other taxes arising from such sale. Any and all fees payable by you pursuant to this Agreement are exclusive of all sales, use and similar taxes, and you will pay any taxes that are imposed and payable for such amounts. If we are required by law or by any administration to collect any value added, sales, use or similar taxes from you, you will pay such taxes to us.
You represent and warrant that:
We reserve our rights to verify the accuracy of the details contained on the Shipping Label and the contents of the Shipment.
You agree to indemnify us for any loss or damage incurred by us or any claim brought by a third party against us arising out of or in connection with your breach of these Terms.
Unless any international convention or mandatory national law applies, we shall only be liable to you for loss or damage to Shipments where we have failed to act with reasonable care and skill and (save in the case of personal injury or death) limited to proven damages not exceeding £100 per Shipment. Where any international convention or mandatory national law does apply, our liability shall be governed by and will be limited accordingly.
We shall not be liable for any indirect, consequential or special damages (all of which terms include, without limitation, pure economic loss, loss of profits, loss of business, depletion of goodwill and similar loss).
We shall not be liable for any loss, damage or delay to Shipments arising from your breach of these Terms.
We shall not be liable for loss, delay or damage to any Shipments arising from circumstances beyond our reasonable control, including adverse weather, fire, flood, war, hostilities, civil disturbances, acts of government or other authorities and labour disturbances or obligations affecting us or some other party.
Claims must be notified to us within 90 days from the date of purchase of the goods by the receiver and proceedings served on us within 9 months, failing which, we shall have no liability whatsoever. Receipt of the Shipment by the receiver without written notice of damage on the delivery receipt is evidence that the Shipment was delivered in good condition.
You have no right to set off any claim against any sums due and owing to us and your rights under these Terms are subject to us having received all charges, costs or expenses (including interest) outstanding in relation to the Shipment the claim relates to.
If you wish to make a claim, you must contact us in line with the process set out in the Help page at Amazon Seller Central or Amazon Shipping. Where such claim is approved we will reimburse the receiver for the purchase price of the goods and any delivery charges paid. Any amount paid by us to the receiver in excess of our maximum liability under clause 5.1 will be automatically deducted from your Amazon Seller Central account. In the event of a claim our Fees will not be reimbursed to you.
These Terms will be governed, interpreted, construed and enforced in all respects in accordance with the laws of the country where the shipment is delivered to Amazon for transportation and the courts of that country shall have exclusive jurisdiction.
If any provision of these Terms is held to be invalid then that provision will be modified to the extent necessary to give effect to the commercial intentions of the parties and to make it enforceable, and any invalidity will not affect the remaining provisions.
In the event any provision in these Terms conflicts with or derogates from any mandatory international convention or national law that applies then that provision shall only be varied to the extent necessary to give effect to the conflicting provision of the applicable mandatory convention or national law and all other provisions shall remain in force.
These Terms form the entire agreement between us and you in relation to the Services and supersede all prior agreements and discussions relating to the same.
No amendment or variation to these Terms will be enforceable unless expressly agreed in writing by an authorized Amazon officer. No modification of these Terms is binding unless it is in writing and signed by both parties.
We reserve the right to make changes to these Terms at any time. You will be subject to the version of these Terms in force at the time of purchase and are responsible for reviewing the Terms and informing yourself of all applicable changes. Your continued use of the Services after Amazon’s posting of any changes will constitute your acceptance of such changes or modifications.
Neither party waives any right under these Terms by failing to insist on compliance with any of the provisions or by failing to exercise any of its rights.
The Amazon Shipping Shipment Policy ("Shipment Policy") is incorporated into the Amazon Shipping Terms & Conditions, and terms defined therein shall have the same meaning when used in the Shipment Policy, unless specified otherwise.
You will be required on Amazon Seller Central or Amazon Shipping to provide certain information regarding a Shipment, including its weight and dimensions. Amazon relies on such information to identify the ship methods available and whether such Shipment can be carried. In the event that incorrect information is provided, we reserve the right to charge on the basis that the correct information had been provided or refuse to carry the Shipment.
Shipments shall be charged based on the actual weight and dimensions of the parcel or package.
We reserve the right to re-weigh or re-measure any Shipments to confirm the calculation and chargeable weight. In the event the actual weight of any Shipment is greater than that declared, we reserve the right to charge on the basis of the weight verified by us or refuse to carry the Shipment.
The following Shipments are prohibited from being carried by us ("Prohibited Goods"):
“Precious Metals” shall mean silver, gold, platinum, palladium, iridium, osmium, rhodium and ruthenium. “Precious Stones” shall mean diamonds, emeralds, rubies and sapphires. “Semi-precious Stones” shall mean amethyst, aquamarine, aventurine, carnelian, garnet, lapis lazuli, opal, pearls, rose quartz, topaz and tourmaline.
Shipments containing sharp objects must have heavy cardboard applied around sharp edges and points to ensure they do not pierce packaging.
Shipments containing liquids must be wrapped and sealed to prevent leakage and surrounded with absorbent material to avoid breakage. Shipments containing glass bottles must be marked "FRAGILE".
Pallets must be shrink-wrapped.
Subject to this clause 4, Amazon does not agrees to transport Shipments containing Dangerous Goods.
We shall deliver Shipments as instructed to addresses in those areas included on the coverage map at the Help page at Amazon Seller Central or Amazon Shipping.
If the named receiver at the address indicated on the shipping label is unable to accept delivery we may deliver the Shipment to (a) any other person at the same or neighbouring address, (b) a safe location at the named address as provided by the named receiver, or (c) an Amazon Locker or pick-up point as designated by the named receiver. Any such delivery completes our delivery obligation.
We may use an electronic device to obtain proof of delivery and can rely on a printed copy of the same as evidence. Where we deliver to a different address or safe location we will leave a delivery notification card at the receiver's address with the details of the location to which we have delivered the Shipment.
We may carry Shipments by any route using any means of transport and may use subcontractors or other agents.
We may take any steps necessary to prevent damage or delay to shipments or persons and may refuse to carry any Shipment which is not compliant with these Terms. By accepting a Shipment, we do not accept that such Shipments conforms to applicable laws and regulations or to these Terms.
We may open and/or inspect or scan by means of X-ray or by any other means any Shipments at any time, at our own option or upon the request of the competent authorities without liability.
We shall not be liable in any circumstances for any delay, loss, damage to Shipments due to seizure or detention of Shipments in the course of transit by competent authorities.
Save in relation to Shipments containing goods prohibited under these Terms, we will carry Shipments containing perishable or temperature sensitive goods but will not provide any special handling and such Shipments are carried solely at your risk.
A Shipment shall be considered to be undeliverable if:
We shall use reasonable efforts to return such undeliverable Shipments to you at your cost but retain the right to dispose of such undeliverable Shipments at our own discretion.
