As experienced sellers on Amazon for eight years, we're well versed in navigating Seller Support challenges and typically resolve issues independently. Our products comply with all regulations in every jurisdiction where we operate. However, we're now facing a regulatory misapplication that requires urgent escalation.
Since October 16th, we've encountered a significant regulatory error on Amazon. fr seller support affecting our EU-compliant cosmetic product. Despite repeated submissions of complete EU Regulation 1223/2009 compliance documentation, Amazon.fr continues to apply irrelevant UK Food Standards Agency warnings to our product - a concerning jurisdictional overreach in the EU marketplace.
This misapplication has created several serious issues:
UK food regulations being incorrectly applied to EU cosmetic products
Valid EU cosmetic compliance documentation being overlooked
Creation of artificial barriers within the EU Single Market
Prevention of legally required French safety warning updates
This deactivation has trapped us in a paradoxical situation where we cannot add required French safety warnings to the deactivated listing due to misapplied UK food standards - effectively forcing non-compliance with EU regulations while citing non-applicable UK guidelines.
With the looming disaster of the December 13th GPSR deadline approaching, this situation raises significant concerns about the application of proper regulatory frameworks in the EU marketplace.
