Generic items being sold as brands with brand registry from other products.

Hello,

I have noticed an increasing number of sellers on Amazon who are listing the same product without any branding, packaging, or trademarks and yet selling it as a branded item. These items are clearly generic and not associated with any specific brand. Upon closer examination, I found that these sellers are listing various products under a single brand name. However, upon checking the trademarks related to this brand, there is only one trademark registered in a specific class, which does not relate to the product being sold or other products listed.

This situation appears to be a loophole around Amazon's brand registry program and renders it seemingly pointless for sellers like myself who invest in trademarks, packaging design, and proper packaging. It seems unfair that some sellers can simply register one trademark in a single class and use it for multiple unrelated items. Despite seeking support from Amazon, I have been passed around without receiving any assistance. The report feature also does not seem effective.

As a result of this issue, we now see an influx of Chinese sellers flooding the market with generic items. They create multiple listings undercutting each other daily with no regard for branding accuracy. Some even have review photos showing either no packaging at all or generic packaging. Such occurrences are likely to cause customer confusion and erode trust towards established brands.

It is disheartening to go through all the necessary steps and expenses to establish our products correctly only to be constantly undercut by sellers who blatantly violate policies. Therefore, I strongly believe there should be a proper mechanism in place to address this issue or an escalation feature within Amazon's support system. As of now, I am receiving no meaningful help from Amazon.

This is really frustrating and annoying to see more and more products pop up everyday, so I ask is there anything i can do? Or is it a lost cause?

Unfortunately lost cause I am afraid there are loads of similar threads over the past year, and no action taken by Amazon.

Although I do not deal in branded goods, the above reply is correcdt. This is a long-standing problem, totally created and perpetuated by Amazon with their Brand Registry. Not just Chinese sellers, but also sellers 're-brandin' already branded goods eg. Cadbury's chocolate as their own brand, and same with other well known brand names. Fighting a losing battle, I believe.

Its become increasingly difficult to list anything due to the brand registry.

I have brand approval for a few brands from years ago but i cant add any more variations to these listings anymore or edit certain attributes as the brand is not registered in brand registry. SS actively tell us to complete the brand registry to gain control which is another reason there is so many duplicate branded listings around of otherwise generic items

100% agree. I faced an issue where another seller reported me for IP violation just because he trademarked a generic product off AliExpress. me and the other sellers were eventually kicked off the listing even though the trademark was registered to an unrelated product class

Couldn't agree more - in recent weeks I have been fighting repeated Chinese sellers that essentially are counterfeiting our items by offering cheap imitations. Support is sometimes good, other times completely ineffective and they do nothing.

You just hope that something has to change - appalling and inconsistent support combined with sellers looking for a quick quid before spinning up new accounts if action is taken. As long as their fulfilment network is busy and they're still receiving their fees then I guess Amazon don't care?

You cant win and you cant get anything done by Amazon. As soon as I figure out the secrets to getting this all done and Amazon not retaliating, I expect ill join them.

So what is the reason for Amazon not taking any action? Simply down to them making money from said accounts?

Makes a mockery of the whole brand registry process.
