Can I re-brand a branded product that is sold by 2 other traders under 2 different brands?r

I would like to sell this product under my brand. This product is however sold under 2 different brands on the internet of which 1 is on amazon. I believe it is the scenario, when multiple sellers do private label at the same manufacturer. What is the best way to go about it?

a) can I sell the product with the original tag (importer’s brand) and with the importer’s EAN?

b) can I remove the tag and rebrand the item since it’s sold wholesale?

or something else?

Thanks

if you item is bought from a supplier and has their brand name on the packaging and an EAN number , those are the details you should be listing against on Amazon

You should only list under your own brand if it is a product you have designed and manufactured yourself - not just rebranded a generic item

To put it simply, if you bought a stock of Mars bars, what would be the point of re-labelling them as Ladsy bars? No customer will ever have heard of Ladsy bars, so you won’t sell any of them. The product you have bought already has a brand name (which may, or may not) be well-known to potential customers, so stick with the one that’s already on Amazon. Wanting to have your own brand name is really nothing but an ego trip: it would take you years of time, effort and money to make the Ladsy brand famous

Do you have permission from the rights owner to sell the branded product?

You can’t just remove the brand labels and rebrand, unless you have the brand owners permission.
I’m a brand owner and I would take a seller all the way if they cut my labels out and replaced with their own.

Obviously it all depends what products you are talking about. i don’t see a problem creating new brand of product and list it on Amazon. In fact, Amazon encourages sellers to bring new product to their catalogue. If you want to list item and manufacturers brand which is being sold here already, you will just enter very competitive environment. if you will create your own brand you will stand out. HOWEVER, if you decide rebrand manufacturers product, make sure it does NOT looks any way similar to one they sell in any way. Register your own trademark and brand here on Amazon too., read seller university. It would help a lot if you would provide ASIN etc. I’m not sure why other members seems to think you cannot add new brand on Amazon, Amazon has special section called Brand Registry for this.

Fair points everyone. The reason this is so unclear for me as a new seller is, that I see it as a common practice on Amazon to sell a generic item under your own brand, sold by multiple sellers. Regardless of how competitive this can be, but people do this. It is another thing, that it’s not a fair practice which I am getting to know here from you all.

To perhaps conclude: Just because
a) this product (weeding tool for garden) is seen under multiple different brands and
b) just because it’s sold wholesale by the importer

it does NOT mean I can go ahead and become another seller of the same product under my own brand?

Atm I am not able to track down the manufacturer, which would make things easier so the most legit way of going ahead with this would be selling the wholesaler’s product with their own branding. But do I still need a permission to re-sell it on amazon? As @Monty mentioned at the top.
