Can someone use my pictures in their listing?
Hi,
i have a PL product listing with pictures that are half sent to my by supplier and half done by a graphic designer,
i have come across 2 china sellers using my exact pictures on their listings.
is there anything i can do about this, or are they allowed to use my pictures for their listing as i have uploaded pics to amazon??

Ask your designer to send you an invoice for the infographics with thumbnails of the finished work included on the invoice then send this to Amazon.

For years we have seen are photos used by other sellers on here and on ebay. I raised issues with Amazon and Ebay about it, and when nothing was done and we put our name on the picture we were told to stop that also. It really is annoying when you spend time and energy to get photos right only for other people to use them.

Copyright always belongs to the original creator - with some caveats. It cannot be taken from the creator. Only they can either pass or sell that copyright on, or in many cases, grant an individual or company a licence to use what was created.
So, yes, get the original invoice and details & contract if you had one. But also clarify if they have held on to the copyright and just given you (and possibly the other sellers - but we will assume they have just stolen them) a licence to use, or passed the full copyright to you.
If it’s not written in an agreement or contract, don’t assume. The original creator may not even have considered it. In that case, you could ask them to supply a written contract or agreement stating you have full copyright and only you. Or you and only you have a licence to use. Doesn’t need to be complicated. A few lines will do.

Are these products exclusive to you?
are they barcoded products and if so did you create the listing?
If it is a product that many people sell then you are only allowed 1 listing , this is not like ebay where there are multiple listings for the same product.

If you read the terms carefully, somewhere Amazon has a proviso that the image rights are waived as soon as you upload to their site.
