Pallet worth 10k lost. Can't claim for loss from carrier or Amazon

I sent a pallet in to XBH1 in mid-September using Palletonline who in turn used Palletline to ship to Amazon.

This was showing on the Palletonline website as delivered on 22nd September.

After 10 days, it was still showing as “In Transit” on Amazon so I opened a case and was told that Amazon had my pallet, there were delays as they were very busy, and that some pallets were not immediately going into a fulfillment centre and instead being stored at an external secure location until the back-log at the fulfillment centre was cleared.

I therefore waited another few weeks but the pallet status still did not change from “In Transit”.

I contacted Palletonline who said that this was most likely because when Amazon store items in an external storage location, they don’t stamp the BOL and so as far as Amazon are concerned, they don’t have it as it was never scanned in to an FBA centre. They assured me that it had been delivered and gave me the digitally signed proof of delivery forms from Palletline showing this. They did not have a stamped BOL and said that they would only be able to provide this when my pallet was taken out of storage and moved to a fulfillment centre.

So I opened a case with Amazon in which the upshot was they will not investigate this without a stamped Bill Of Lading which I do not have. Amazon could see that this pallet had been diverted to an secure storage location, exactly as Palletonline had predicted.

Palletonline tell me that it is not uncommon for Amazon to accept deliveries without stamping the BOL’s as this is time consuming. The shared with me a letter from the Inbound Carrier Manager at Amazon which appears to say that Amazon accept that stamped BOL’s are not required in the event of a Quantity Variance Dispute.

I shared this letter in the case with Amazon, but the rep said that this letter does not relate to FBA shipments, referred me to Amazon T+C’s saying that a stamped BOL is required and closed the case
again. I’m not sure what other shipments it could relate to if not FBA shipments?!

If what Palletonline are telling me is true, then it appears that Amazon sometimes don’t bother to provide stamped BOL’s when accepting shipments. In the event that the shipment goes missing, they then demand the stamped BOL as proof of receipt which they never gave out in the first place.

Palletonline tell me I cannot make a claim with them because they have proof of delivery, Amazon won’t even investigate as they did not provide a stamped BOL to the carrier when the delivery was made.

Does anyone have any ideas on what I can do?

How long has this pallet been missing? I used to send several shipments of pallets a week and I have often encountered delays of 2-3 weeks from check-in; it seems to be particularly bad when it goes to an external location because of the lack of BOL.

From my experience, you are in limbo land so just be patient and in time it will turn up and get checked in. I am guessing its getting busy now because of the run-up to Black Friday and Christmas.

If you can afford it I would send all parcels via courier (about £4-5 each up to 23kg). It’s far quicker and I have yet to have a missing shipment, so I no longer use the pallet service.

Unbelievably, just as I posted this, I had a reply back from Palletonline (who have been absolutely excellent and honest throughout this whole saga) saying that Amazon have acknowledged that they have my pallet. They have screenshotted a communication between Palletline and Amazon saying that the pallet is still at the external storage location and has not yet been moved to a fulfillment centre.

So therefore, Amazon did not follow it’s own T+C’s - they accepted the pallet without stamping the BOL, exactly as Palletonline predicted had happened.
