You use the brand name and EAN as is shown on the product you plan to list, if it’s already in the Amazon catalogue, then you add your offer to the existing product/brand.
If the item has no brand, or EAN (barcode) and generic, then you list without a brand (unknown) or, you have the manufacturer brand it in your brand name.
To check if TM brand names are in use, you would need to check with the IPO (online) as even if not being used on Amazon, it may be a TM registered brand and using it would be infringing the owners rights (illegal).

You should always enter the correct brand name when listings products for sale on Amazon, exactly matching the product which you are selling.
Be careful not to use your store name, unlike many other sellers are doing. If you are selling generic items, then use “generic” as the brand name.
If you are planning to register your own brand and have it trademarked, you will be able to search existing trademarks within the database or the better option would be having a professional service provider do the search for you, to ensure your desired trademarked brand name isn’t already taken.
