Suspected intellectual Property Violation

Suspected intellectual Property Violation

I did receive ‘Suspected intellectual Property Violation’ from Amazon.
Amazon is telling me that:
'"We have removed some of your listings because you may have improperly used Copyrights of “The Lion King” you do not have the right to use on the product detail pages for your listings.

And here is my first question:
Why Violation has been applied to my selling account in case where:

  • I did not create these listing,
  • I did not add and information to these listing,
  • I did not add any images to these listing.
  • it was product page already existing on Amazon not created by me so calling it my listing is not really correct?

Second question:
I have added my offer under existing listing (already live on Amazon - created by manufacturer), as going by EAN code if listing exists under this EAN I can not create new product page but only add my offer to already existing offer and product page:

  • In this case am I still responsible for all information and images shown under this existing listing?
  • even if other sellers or company creating this listing added these to this listing?
  • even if listing will be updated with time by other sellers or amazon with incorrect information?

Please reply only to these questions. I would like to mention only that manufacturer allow us to sell their products here and they have valid right owner’s licence to produce and sell these products etc.

Any help would be really appreciated.

I wish that I could provide you with some useful information in response, sadly I cannot, but what I can do is say that I have had this exact same issue today and was looking here to see if I could find out anything. Hoping you get a positive reply from some experienced sellers.

Regardless of who created the listing, what is in the listing, or how many people are selling on the listing, do you have authorisation to sell the product from the manufacturer or authorised distributor?

Suspected IPs like this usually happen when a known name - such as Lion King, is used with the ‘incorrect’ brand
It’s not Incorrect, it’s just the licensee usually

Ourselves, @Smiley_Guy and @Simply_NikNaks1 often come across this problem with Disney, marvel etc

Are you able to edit the listings ?

Quite often, deleting them removes the violation - although not always

Follow the below pathway to submit the documents:

Performance > Account health > Policy compliance (select the violation type) > Submit appeal

As others have said sometimes its not the fact the listing is active (possibly with incorrect information but lets leave that for now) but the fact Amazon are checking if you in particular have the rights to sell the item.

Just because an item is already listed in the Amazon catalogue does not mean anyone can add an offer to the listing - especially when its a branded item. To sell a branded item often means you need permission.

Get a letter of authority from the manufacturer and also ask for a copy of their licensing agreement with the brand. If you are on good terms with them they will know the problem and it should not be a problem. Then upload those docs as Mary says above.

…wouldn’t it be easier if Amazon would be asking about that straight away without all these misleading messages and replies?
It is like talking to robot when we contact Amazon sometimes which is really not good experience.
Like mentioned previously this is licensed product and we have received permission from Manufacturer to sell this.
If any type of letter confirming this is required then we ask Manufacturer to provide one for us.
But the way how this whole case is being carried over is not the best way of treating Amazon Sellers.
We sometimes (very often) feels like we were scammers and thieves.

From your post we understand that you need the template/requirements of the Letter of Authorisation:
As per the Amazon the LOA or LA that you submit must meet the following criteria:

  1. Scanned copies of agreement in PDF or image format are accepted.

  2. All information must be obscured and easy to read.

  3. Must be signed or stamped by the brand or manufacturer.

  4. If you own the trademark in question, provide proof of ownership.

  5. Screenshot of email from brand owner is accepted, but the email must be sent from a brand domain.

Amazon may validate your LOA or LA by contacting to the relevant brand owner that you identify in your application.
