Item returned opened and smell of cigarette smoke
Hi, can someone please answer a question I have. A item has been returned after a one and a half weeks was received on the 4 august by the customer. returned back today 13 august opened and smells of cigarette smoke. He sent the item back stating - I thought this was what was required though I was mistaken. How mush of a refund should I give back. Thank you in advance

It looks as though they changed their mind, therefore, they should pay for return postage. Also, depends if you can re-sell the item and for what price. Lets say the item sold for £35 and now it’s only worth £20 as it has been used, so I would only refund the difference. However, they may open an A-Z claim and this would just refund them the full amount. (I think this is the correct advice). However, I’m sure more seasoned seller might have a different take on it.

As this seems to be a change of mind return, it should have been returned in the same condition as when sent out, so you are at liberty to not refund the whole amount (and also not the cost of the return postage). I think people say 50% but maybe others will suggest differently.

The cost of the item is an important factor e.g. I would not risk an A-Z for an item that’s just worth a couple of quid.

It depends what the item is, buyers generally have a right to open and inspect a product, but not use it and return for any reason within Amazon 30 day return policy.
This appears to be a change of mind return, so should be returned in the same condition as sent and unused, if it’s not then you can make a partial refund if it’s been used, or damaged by the buyer.
Difficult to advise further given the limited information provided?

The item cost was just over £60 and he has asked if the refund will include the £7.00 return postage as well

we had an order returned a few years back which arrived covered in cat hair! my wife is high allergic to cats! (to the point that blues and twos to hospital if she were to pick a cat up) when asked about it, they claimed they had never opened it, yet they returned it as it didnt fit! Then they tried to claim they didnt have cats until we pointed out we had seen them on their social media page! so then they try to claim the item was opened at a friends house…
We refused to refund and Amazon actually (for once) agreed and closed their claim.
