GPSR Responsible contact person, based in UK?

Hello,

Under the GPSR, it's stated that a ‘Responsible Person’ needs to be established within the EU for non-food products. However, I've seen several sellers using UK-based companies as their designated responsible contact person, given that the UK continues to participate in some EU trade aspects via the Northern Ireland Protocol.

Could a UK-established company still fulfill this 'Responsible Person' role for GPSR compliance, especially if registered in various EU countries?

The UK left the EU in January 2020 but remained within the single market and customs union during an eleven-month transition period to ensure trade continuity, which may support this approach. I'd appreciate any insights or experiences you may have on this matter

No - the responsible person must be in the EU. Obviously it could be linked to a UK company - but the responsible person details provided must be in the EU.

Its not clear if it would allow a Northern Ireland based responsible person. All documentation I see refers to 'within the Union' but I can't see it would allow a UK based designated responsible person.

Under the GPSR, a Responsible Person within the EU is required to ensure compliance for non-food products. Since Brexit, with the UK no longer part of the EU, it’s important to clarify whether a UK-based company can still take on this role, particularly through the special provisions under the Northern Ireland Protocol.

The responsible person has to be based in the EU, as Northern Ireland is both EU and UK it can be in Northern Ireland, however any seller selling to Northern Ireland will now need to abide by the GPSR rules, have a responsible person and upload all the manufacturer details and compliance documents and don't forget that every product must be labelled by the seller with the responsible person details, the manufacturers details and the compliance details, if it does not fit on the product it can be on a separate sheet included in the package.

I have no doubt that most UK sellers will now not send to NI as the cost of meeting this requirements in time and effort will not be worth while, whilst the Northern Ireland loyalists will be fuming that they are now different to GB over this issue.
