Can I list my China items as no brand/generic without a trademark? PLZ HELP

Can I list my China items as no brand/generic without a trademark? PLZ HELP

Hello

I recently placed a large order from china with a brand name for the product that I picked myself.

Ive now come across artciles saying I need to have a trademark.

I know that without one other people can jump onto my listings etc but my question is, will i be able to sell under generic or no brand, if my item has a name on it?

Ive ordered a big order and didnt factor in a trademark and have been up all night worrying :frowning:

The name of the item is quite niche specific so if i registered a trademark it would have to be something generic that is different to the name my product anyway so that i can use it on other products…

ANY help with be much greatly recieved.

Sorry do you mean the product already has a brand name ? Or have you created your own brand name and had it applied to your product ?

If the latter, without a trademark and amazon brand registry , you’ll need to list it as generic

Did you purchase barcodes from gs1 or apply for gtin exemption ?

assuming you have spent money on stock and shipping why not apply for your brand trademark at the IPO, its £150 and takes about three months, also once you apply they contact you and are really helpful.
Even if your product doesn’t do well you can use your trademark on anything you sell, if it does do well sell under your brand name but use generic in the listing, if it gets hijacked close the listing and once you have brand registry reopen it and kick the hijacker off.
I know your being cautious but getting a trademark is one of the best investments you will make if your serious in the long term.

Its not perfect, i mean, Create the listing using the word generic in brand name. ’ You have to put something in’ But in the title of the listing use the brand name you are intending to use for your product.
I now its not perfect and you have no protection but it gets you started if its your first product and as i say you can close the listing and reopen it once you have your trademark and brand registry.

if you want to take advantage of the brand registry feature as a professional seller and you have determined this is a product line you intend to continue selling I would apply for the trademark anyway as the cost is not all that much. It can take several weeks for approval from the IPO, but once approved and you have it registered with amazon brand registry you will be protected from copycats - if you act fast enough it may not be an issue.

I think unless you are about to launch a unique product and have lots of sales from day one, its very unlikely someone is going to try and steal your brand name or logo.
there are lots of online videos how to get a trade mark and brand registry, i found the hardest and most expensive part was setting up a web page for amazon brand registry after i got my trademark, the trademark bit is easy.

the products ive ordered have the product name on ie Nike

I havent registered a trademark yet. So this means I have no power to stop others using my listing unless i trademarked the name Nike?

What Im confused about is this.

As a private label product, does the product name I input on the listing have to be the same as my trademarked name in order to prevent others from using my listing?

And does my trademark have to be present on every one of my products? Or can I use different product names and list them under my trademark.
