Missing FBA inventory which Amazon is now selling as its own inventory without compensating us

Hi,

I wonder if anyone has experienced the following and how did Amazon rectify the situation as we have had an open case with seller support for 3 days without reply:

We are missing 300 x items from a FBA shipment Amazon received at their warehouse. The other 1500 items in the shipment of different sizes and colours went into stock on FBA fine.

Amazon have requested further proof of delivery to the Amazon warehouse.

In the meantime the only size and colour that went missing from the shipment has appeared for sale on Amazon with Amazon as the seller. They are selling it cheaper than we sell it, so can’t be dropshipping.

We have only ever been the seller, the product is branded with our registered trademark and we are registered with Amazon brand registry.

We have ordered the product to confirm Amazon is selling our missing inventory. We received the item last week. The item we were sold by Amazon is the item we sent to Amazon! We determined this by looking at the product, packaging and barcode stickers.

Basically, our inventory has gone missing at Amazon and now Amazon are selling it as their own inventory.

Obviously we don’t want to upset Amazon but at the same time are quite shocked by this. Has anyone got any experience of this? Advice?

First thing first, have you reconcile the shipment? were the missing item mixed in with the other ASINs? Can you provide the POD?

secondly, if you were able to claim back the missing from the shipment (i.e. Amazon paid out); then they are legally able to sell them, until then those stock do not belong to them.

How long ago is this shipment?

This is normal, although you will need to confirm that Amazon have reimbursed you. (It normally shows under the other column as a credit.)

An update: no reply from seller support, brand registry or any of the Amazon email addresses.

Amazon is still infringing our trademark and selling our inventory as their own inventory.

We have written a cease and desist warning to Amazon.

We are contemplating going to the office of fair trading and potentially the media over this.

I believe in the US Congress is currently looking into this predatory behaviour with a view to making Amazon split its retail sales and its third party retail business. .

I have had something similar with a branded item that I sell, I know the brand owner was trying to pursue it. I have been trying to get compensation for months but the proof of delivery from UPS only has an Amazon employees name on in the current world of no signatures which is not suitable proof of delivery!
All the items ‘missing’ from my shipment appeared on sale and the brand in question refused to sell to Amazon directly
