Other seller is attached to my branded product listing

Hello,

I launched my product in Nov-24 under my brand and recently another seller is attached to my listing. My product is listed under my brand and I have applied for brand registry with my company information. The other seller is now selling the product at a lower price therefore I also lost the featured offer. Please help me.

One of the risks of starting to sell BEFORE you are actually IN BR is that Amazon will offer almost no protection.

Is your brand one that is registered with the USPTO or is it just a trade name that you are using?

IF it is in the USPTO you can try test buys and report the other seller for an IP violation IF it is not your product.

Another risk since we don't know what you are selling (providing ASINs is actually helpful!) is that you sourced from 'offshore' and your supplier did an over production run. They then sell YOUR product to others to move the over production (which may or may not have been 'accidental'). In that case the other seller has 'real' products that they probably paid much less than you did to acquire.

First, you need to identify if this other Seller on your listing is selling the actual product. You can do this by completing a test buy from that Seller and inspecting the product when you receive it.

  • If the product is authentic, this is not an IP violation and Amazon cannot enforce exclusive distribution. Further info on this is in the "Types of notices not accepted on Amazon," section of the linked help page above
  • If the product or packaging infringes on your Trademark, Copyright or Patent, you can report this via the Report a Violation workflow on the Brand Registry site. Step by step instructions are provided in the help page linked above
  • If the product you received is different than the product on the listing, this is not an IP violation and needs to be reported via the Report Abuse workflow in the Account Health Dashboard.
