GPSR green ticks

Amazon's GPSR portal is still not working. The resolution date has moved from the end of September to end of October to 8th of November.

I am trying to get confirmation from them that the action I have taken on a handful of products means they are now compliant. I keep getting different answers. I am not prepared to spend the hundreds of hours needed until I know I am doing it right.

The most common answer is, if you have a green tick next to the photos then they have been accepted.

However, by accident, I uploaded a photo of my cat on one ASIN and the green tick appeared.

Now my cat certainly does not come with safety instructions in any language and occasionally can be quite a dangerous item.

Does this mean that further down the line Amazon might start rejecting photos?

Amazon have just replied in another case saying the issue will now be fixed by the 15th of November.

Assuming they don't move the date again this gives 28 days to resolve everything.

This GPSR is a disaster waiting to happen, regardless of the responsible person details, how is a label with the responsible person details going to be to attached to every product, which is a requirement of the legislation?

Are Amazon going to do this with all their inventory as well and who is going to attach the label and who is the responsible person going to be?

GPSR is a convoluted EU directive which is so complicated that nobody really understands it and it is supposed to protect consumers from products that might harm them that was previously covered by the CE mark that was the responsibility of the manufacturer.

So why is the seller now responsible for adding the responsible person details and adding the label to the product?

The Amazon system for adding the responsible person details is an embarrassment, there isn't even a search function to find one and if you add your own details and they are accepted you have to scroll through hundreds of names to try and find it and who wants to be responsible for a manufacturers product?

There is no doubt that if this is enforced by Amazon on the 13th December it will wipe out thousands of listings overnight as no manufacturer or distributor seems to even know what is happening, seller support know nothing and the advice given is ambiguous at best and the page to enter the responsible person details is useless with no search or explanations.

The EU have stated that they will be undertaking test purchases from shops to enforce the legislation and issuing fines of up to €35k for non compliance, they are also intending to purchase from online entities and if the product has a responsible person registered, but there is no label on the product, then a fine will be imposed.

Then there is the issue of UK to Northern Ireland where the legislation will apply in the same way as the EU, so if a UK seller is sending to Northern Ireland they will need to abide by the rules and have a responsible person and a labelled product to be able to send it to what is an integral part of the UK and now also the EU (Thank you Boris and Brexit)

To top it all off if you have your responsible person registered and you have labelled the product and the person buying the product injures themselves with it or burns the house down, the responsible person will of course be 'responsible' for whatever happens, so be aware, make sure that the responsible person is the person or company that are going to be responsible for the product.

It would seem to me that in ALL cases the responsible person should be the manufacturer and the manufacturer should label the products accordingly, but what about the 10's of millions of products that are already in the channel and have no labels? What about the Amazon list of responsible persons that contains about 50 names, none of which match the manufacturers of my products?

I have spent a good bit of time looking into this and there is no possibility of doing what is required by the 13th December, in addition the manufacturers and distributors seem as clueless as everyone else. So is this could be another EU directive where the EU are unable to enforce the legislation in a lot of cases, however as they have Amazon and others onboard who are going to take down listings with no linked responsible person, if the details cannot be added then the listings are gone and sellers have nothing to sell.

Lets hope someone can make sense of this before 13th December which is less than 8 weeks away, if not a huge chunk of the Amazon catalogue will disappear overnight.

If the EU come to their senses then they will delay this legislation, allow people to understand what they need to do and try and get it sorted out.

Why are Amazon not asking the manufacturers of the products to do this and add their details to the responsible person list, so many questions and no answers.

I suppose the answer for UK sellers is don't send to the EU or Northern Ireland as, in the case of EU sales many UK sellers already do not send to the EU after Brexit, but what about Northern Ireland, it is supposed to have the same rules as the mainland UK and yet this EU directive applies fully to Northern Ireland after the Windsor protocol and UK sellers have to abide by it.

Good news. I am delighted to share it.

Seller Support have written back (it has taken a couple of months) and confirmed that the photo of my cat is acceptable.

Slightly rude. She is more than acceptable. She is very pretty.

However is does make me doubt the accuracy of Amazon's processes.
