First Suspected Intellectual Property Violations

Hi guys

Just received my first Suspected Intellectual Property Violation.

I’m quite worried as not sure how it effects your account I’ve read this forum to look for answers but a lot of people getting suspended.

My question is will I be suspended for 1 violation? If not how many triggers a suspension?!

Not likely
You have the option to edit the listing removing any infringement. This will show on the infringement usually in the title.
Once you do that within 24 hours that will correct and be removed from your account health…

Thanks for reaching out. I understand you are concerned about the alerts for Suspected Intellectual Property Violation on your account health dashboard and would like to know how to resolve this.

Not addressing it proactively might lead to an account review and if a valid appeal is not provided during the review then a suspension would take place. However, the concerned team will proactively reach out to you, should there be any review on your account.

As mentioned by @UK_GIFT_STORE_ONLINE,

I encourage you to proactively remove the ASIN(s) flagged in the dashboard and appeal with a plan of action.

Be concise, specific to the issue identified, work on the following points and think about long term solutions.

1. Root cause: What went wrong that the issue had come up?

  • Did you seek permissions before mapping? If you have permissions, provide the same.
  • If you do not agree to the claim, you must provide valid proofs to challenge this.

2. Corrective measures: After receiving the notification, what steps had you taken to resolve the issue?

  • Did you contact the Right’s owner to get a better understanding of this issue?
  • Did you reach out to your supplier to confirm if they were authorized to sell the brand in question?
  • Did you check your existing listings to see for any infringement which may have gone unnoticed?

3. Preventive steps: Think long term! Do not limit your plan to the specified ASIN(s).

  • What are the changes you can bring in to control or to avoid similar violation?
  • If you are not authorized to sell a brand, how will you make sure to not list it?

To consider an appeal to be valid, the seller performance team generally focuses on the following points:

 Did you fully comprehend the specific policies and the root cause that led to the enforcement action;
 Removed all listings they were reported for and associated or similar listings.
 Provided a reasonable plan to avoid any policy violations in the future. Provided valid invoices, letter of authorization, images, or licensing agreements.

If you do not agree to this violation, you can contact the Right’s owner to see if the claim was raised in error and ask them to send a Retraction letter to our seller performance team. If they send, your account health dashboard will be updated accordingly. If not, a plan of action is needed.

Once you are ready with all these points, you can send it across through the “Appeal” button to the right of the ASIN(s) from the Account health dashboard and the concerned team will get back to you.

just delete the asin in question and you should be ok this is a suspected intellectual property violation not the much more serious received intellectual property violation it will disappear from your metrics before to long if you delete the asin in question
