Real or Fake - Email about copyright infringement

I received this email yesterday. I gave it a day to see if any notifications popped up on my Seller Central, but they haven’t

No copies of this book have been removed from my inventory
Nothing has appeared in my Account Health
Nothing has appeared in my Performance Notifications.

Am I missing something?

Hello,

We removed some of your listings because we received a report from a rights owner that the products listed at the end of this email are unauthorized reproductions of copyrighted materials. The rights owner communication about the alleged infringement and the listings we removed are at the bottom of this message.

Why did this happen?

We received a report from a rights owner alleging that one or more of your listings is infringing the intellectual property rights of others. Amazon policy prohibits you from selling any products that are not legal for sale, such as products that have been illegally replicated, reproduced, or manufactured (https://sellercentral.amazon.com/gp/help/G201165970).

We’re here to help.

If you need help understanding how your listings may infringe the intellectual property rights of others, please search for “Intellectual Property Policy” in Seller Central Help (https://sellercentral.amazon.com/gp/help/external/201361070).

Have your listings been removed in error?

If you believe the product for the ASIN below is not an unauthorized reproduction of copyrighted materials, you may submit a dispute by filing a counter-notice under the Digital Millennium Copyright Act.

If you think that the rights owner has made an error in sending the notice, please reach out to the rights owner and ask them to submit a retraction of this notice. We may only accept retractions that the rights owner submits to us directly. We do not accept forwarded or attached retractions.

These are the rights owner’s contact details:

– ES Press Inc

espresstucson@gmail.com

How do I submit this information?

Go to Received Intellectual Property Complaints under the Product Policy Compliance section in Account Health (https://sellercentral.amazon.com/performance/dashboard?ref=ah_em_mpa) and locate the deactivation record for this product listing. Click on the Appeal button next to the listing deactivation record. Dispute the violation by submitting a DMCA counter-notice (https://sellercentral.amazon.com/gp/help/G202017130) from the Explanation link located below the appeal form.

What happens if I do not provide the requested information?

If we do not receive a response, the listing will remain deactivated. The violation record will remain on your Account Health page for up to 180 days after the listing was deactivated or until the violation is successfully disputed. Deleting your listing on this ASIN does not sufficiently address the reason for the violation and will not result in its removal from your Account Health page.

We reserve the right to destroy the inventory associated with this violation if proof of authenticity is not provided within 60 days. Violating this policy may also result in the deactivation of your seller account, or other legal consequences.

Rights owner communication: We had submitted a previous complaint ID#: 10560205581 that more pirated copies of the title: Emotional survival for law enforcement: A guide for officers and their families Paperback – January 1, 2002 ISBN: 978-0971725409 ASIN: 0971725403 were being sold on Amazon.com. We were informed that we needed to perform a test buy on amazon.com to address this pattern of pirated copies being sold on Amazon.com. We have performed the test buy and have the report from McNaughton & Gunn printing company as required and the rights owners is asking to have all non-authorized offers removed off Amazon.com and future offers required to show proof of authenticity to sell this item. The only authorized seller on Amazon.com of this title is the seller: Outdoor Supplies, Apparel, and More. We have a full report from McNaughton-Gunn that shows that this book is a pirated copy being reproduced and this second buys shows there is a pattern of fraudulent copies being resold on your marketplace.
