Potential Trademark Logo Misuse (HP)

Afternoon all,

After listing a few laptop accessories the other day I received a “Potential Trademark Logo Misuse” notification on one ASIN. The product is an HP OEM branded stylus pen, in Used/Good condition.

It appears whoever created the ASIN (B078HL5Y14) has branded it “For HP” rather than the actual manufacturer “HP”.

I didn’t create the ASIN and I’m unable to become an authorised seller for this brand as I only deal in second-hand items. This means I don’t have permission to edit the brand on the ASIN in order to have it reviewed.

On top of that the ASIN now appears to have disappeared from the catalog, I have deleted my listings and can’t create a new offer for this ASIN.

How do I go about having the “Suspected Intellectual Property Violation” reviewed in this case?

Even if description would contain only “HP” you would need a permission to sell your goods with brand “HP”. Is Amazon asking for any action from your side?

I think brand “For HP” is the problem here as you are not IP holder for this brand, I doubt it that Amazon will change brand to “HP” as you are not brand owner. So you said that ASIN is gone from UK catalogue but still present in US Amazon? I presume you are trying to list in UK. In that case if ASIN is not there anymore and you cannot locate correct product, I suggest you create new ASIN in catalogue, however once you add brand “HP” it might ask for permission to sell. Well I’m not sure about used items probably they don’t require permission, but for new ones you would probably need to provide permission or invoices for goods. As for Suspected Violation - is Amazon asking for Plan of Action of anything from you?

It sounds like the product detail page has been removed, which may mean that it’s not you listing the product that was the problem, but the listing itself.

Could it be that the product on that listing wasn’t a HP branded product, and was instead a third party product compatible with HP that has been flagged as violating HP’s trademark?
