ASIN Hijacked by another seller

I seem to have had one of my best selling item hijacked, which i created in February 2015!!
Description and Brand Name changed and variations added by 2 other sellers!
After spending 40 minutes on phone to seller support they advised me to open a product violation case
They replied in about 15 minutes basically telling me tough!!
Can anyone give me some advise as this is i my Top 10 selling items with over good 600 Reviews

The advice you have been given on this is good advice but to be honest there is very little you can do about it and are completely at the mercy of Amazon.

This is one of the very reasons why Amazon try and get sellers into brand registry and although someone has violated policy, it is a lottery to how this will be handled by Amazon seller support.

First and foremost you have to understand that listings are not hijacked by sellers, all listings are owned by Amazon regardless of creation. If you become a brand owner and claim a brand, I have seen this happen so many times, you will go round in circles with seller support.

I am guessing it hasn’t actually been brand registered as the next step could be that the brand owner will report you for infringing on copyright and have you removed from the listing. Sorry this is not meant to scare but I have seen this happen many times before.

If an ASIN is not brand registered, then anyone is entitled to jump on it and can suggest a change to it. If the suggested change is seen by Amazon as a reasonable change adding to the product then this will remain and you would be hard pushed to get it changed back.

  • You must not use an existing listing for a new version of a product. Changes to a product’s packaging colour, design or material do not require creating a new ASIN. Only when the product being sold is either materially different or changed in brand value is it necessary to create a new ASIN. This includes changes in colour, size, material, features and product name. For example, a manufacturer updates its streaming media player by adding a new remote control with four buttons instead of two. This product is materially different from the older version and it must be listed as a new ASIN.
  • You may only update detail pages to better or more accurately describe the product as originally listed. You may not change/add the ASIN title, brand or manufacturer name in the respective data fields (even if one does not exist, i.e. where the ASIN was created without a brand or manufacturer as a ‘no-name’ or generic product) unless the updates include additional details, clarifications, grammatical fixes or removal of content that violates Amazon policy.
  • If you choose to re-brand a product, you must create a new ASIN rather than update an existing ASIN. This is true even if the product is unbranded and does not change materially after the brand change. This includes adding a brand to a previously unbranded product.
  • If you believe that the brand or manufacturer name on an existing ASIN is incorrect, contact Seller Support and provide all available evidence to support your position. This includes if you are unable to list a product with the correct UPC because that UPC is already in use for another ASIN. Do not make changes to the original ASIN. Instead contact Seller Support with proof of UPC ownership and request that they create a new ASIN for the same UPC.

Good advice from @JR_Wristbands If this does not work, another possibility would be to recall your stock (if it’s FBA) so no customer will complaint item not as described. Purchase item from seller and raise complaint with Amazon that item is fake, not the same brand (you can attach picture of your item), that it’s not hoola loops etc. this should immediately restrict this seller from selling this ASIN at least till you sort your brand. Next step would be to create your new ASIN (with your brand) and request to merge with hijacked ASIN, now this is where I’m not sure which info is being transferred when merging (if Amazon transfer brand from hijacked ASIN then it’s a no go.) perhaps other sellers know what info is being transferred. this way you would have your ASIN back
