Read onlyMy company is based outside the UK and Europe and I recently started selling on Amazon UK. I applied for the UK VAT in February 2024. and my application was approved in July 2024. in the VAT approval document, it says that the VAT registration was back-dated to March 1st 2024 and I must pay UK VAT on all sales that took place between March 1st and July 31st 2024 even if I never collected any VAT.
The problem is the VAT during this period was collected by Amazon and was not given to me. is there a way I can get this VAT money from Amazon so I can remit it to the HMRC?
Thank you all :)
Legally, Amazon are responsible for collecting VAT and sending it to HMRC for any company not established and not physically operating from the U.K., or where the owners are NETPs.
As such, the VAT has been paid and you will not be able to recover it from Amazon. However you shouldn't have to pay VAT twice.
If the goods are in the U.K. using FBA, this is from HMRC website:
"When the goods are sold to the customer, the overseas seller will be considered to have made a zero-rated supply of the goods to the online marketplace, known as a ‘deemed supply’. The overseas seller does not have to issue invoices to the online marketplace for deemed supplies that are considered to be zero-rated."
