Another seller is selling under my ASIN

Help!
I don’t know if it is the same product, because his inventory is only available at the end of August. Because my trademark is still in the process of registration (published but not yet registered), I cannot report him as trademark violation. All the text content was written by myself after spending lots of time keyword researching. All the images were conceived by myself and designed by a paid graphic designer.

Is there a way to protect my sales? what am I supposed to do now as a new seller?

Is the ASIN listed as generic? Any branding shown on the listing? I assume it isn’t a product you’ve made yourself?

Is this a product that you specifically manufacture and design yourself? Or a product purchased from a supplier - possibly China and your supplier has made more than you ordered and sold off the rest ?

This is the problem with Amazon, as opposed to eBay where you can tailor your listing exactly how you want it and optimise it for keywords. On Amazon, anyone can piggyback off your hard work and list their item on your listing. They can even make their own changes to the listing and ruin everything. The only way to kick them off is if you have specially purchased an EAN / barcode number for your product. In that case, you essentially own the listing because no one else will have that EAN number.

The best way forward for now is to send that person a message if he ignores or don’t reply back don’t worry send him another one after couple of days and if he doesn’t reply back don’t get frustrated after every few days send him a final message make sure you mention in that message that this listing belongs to you and you are the owner and you will complaint it to Amazon. because I have been through this and the day you get your certificate make an official complaint to amazon that this person is on my listing since whenever. also send show them the evidence that you have sent him so many warnings

Amazon will block his account permanently and if you get any bad feedback on your listing because of that seller that will be removed because once your trademark is registered it starts from the day you make an application not from the day they have registered.
