IP Claim for a product I have never sold
Hi Guys,
Pleasantly woke up today to a 'Suspected IP Violation' for a product that was in my inventory but I have never sourced or sold before, they are saying that the listing is at risk of removal, which I really do not care about, but I don't want this violation on my record.
Upon inspection I can see it's because the brand name has changed on the product from the real brand 'Loctite' to some 'Funmily'. ASIN is B07R3GWXF9.
Seller support is saying that to remove the violation I must change the trademark from loctite to funmily to ensure it matches. But that does not make any sense, I then said the brand should be changed from Funmily to Loctite, as it actually is a Loctite product. He then said, well do you have letter of authorisation from Loctite to sell the product? I said, well I added it to my inventory as I was considering buying it from a wholesaler, which is usually an adequate substitution to a LOA, and that I just never went ahead with making purchase.
He then went on and on about how this violation can only be removed if I change the trademark to funmily to ensure it matches the brand name. I ethically cannot do that as the brand name IS NOT funmily, it's Loctite. So what do I do? How do i remove this?
Kind Regards

Usually if you just completely delete it from inventory it removes the violation for suspected IP violations, though not guaranteed

Hi @Seller_w5M0a9wYTqQt2,
Thank you for reaching out!
I can see you did submit an appeal case today, which is still under review.
Please keep me updated on the outcome of this case.
Cheers,
Julia.

There's also several sellers on that ASIN - so even if you did change the brand, which you shouldn't, you couldn't guarantee it would even do anything anyway!
That being said, its possible its a fake duped listing anyway of this listing so you could either delete the listing from your inventory or change the brand to match - as it doesn't matter either way, as its a busted listing that you aren't selling.

This has happened to us a few times and its deeply frustrating. Other sellers changing the brand name on a product so they can get exclusivity. Then they raise an IP on it. The seller gets penalised and the brand name ends up not being the right brand for that product. Yet another broken issue in Amazon.

Your appeal is almost going to change nothing. One, Amazon will put it down as your fault -it is not, this is Amazon's catalogue issue which they will never admit.
I am speaking from experience. They simply, want you to acknowledge your error {tick the box} and the warning is removed.
Two, remove the product and search the catalogue again for the {new} correct ASIN for it
Three, consider abandoning the product.

Maybe an email to Loctites legal department would be a better option.
I'm quite sure that they will not be happy with sellers / Amazon misrepresenting their brand

Hi ive got the exact same issue under the exact same ASIN: B07R3GWXF9. it seems like they are handing out IPs to everyone who had this product in their inventory. Likewise ive never sold the product ive just added it to my inventory.
What a nightmare.

This is a common issue on Amazon. Its a racket - we've had atleast 10 listings just been hijacked by people claiming IP.
These dodgy companies found a nice loophole in Amazon cataglogue....a listing that has existed since 7 years being gifted to someone who has just been in business for 1 year. File an IP and send violations to everyone selling under the listing.
Amazon will not do anything about it.
