Wrongful IP Enforcement – Account Deactivated in Error (ASIN B0DGL4LDYZ)

Hello,

My account (OMUR LTD) was deactivated due to an alleged Intellectual Property violation related to ASIN B0DGL4LDYZ. However, this is clearly a wrongful enforcement / misclassification:

My Account Health Rating is 204/204 with zero violations or IP complaints.

The product is a generic Spider Theme Balloon, not a Marvel item.

The same ASIN is still being sold by Amazon US and other sellers, which proves the product itself is not restricted.

I sourced the product directly from Amazon.com (Seller: SIXONEAIEN) with full invoices (attached in my appeal).

My compliance system (MongerLab) automatically blocks restricted brands like Marvel and prevents such listings.

All of my employees completed Amazon IP Compliance Training.

I have already removed the ASIN from my inventory.

Despite providing all this evidence, my appeal is quickly rejected within a few hours without proper review.

👉 I kindly request that this case be escalated to a senior investigator for detailed manual review, as this is not a real IP violation but an enforcement error.

You are absolutely right. Amazon US and other sellers are selling in the UK, and the supplier and brand owner are also selling on amazon.com, but only your store remains closed.

This is a big problem.

Amazon is applying double standards here.

There is your problem. There are numerous examples on this forum where Amazon do not accept Amazon invoices. You need to buy from an authorised wholesaler. Amazon would be classes as retail. The original seller may well have authority from the manufacturer to sell on Amazon, that authority may not be transferrable to a retail buyer.

Dear Larry.

I do dropshipping on Amazon and find and add these products using Amazon SP-API compatible software.

Here's the situation: the spider theme on this product isn't just on Marvel products, it could be on many products; it's a trademarked product.

The seller in the US is selling this product, Amazon has authorized it, and sellers on amazon.co.uk can also sell it.

So there's no major problem with the product.

If there were a problem with the product and Marvel complained, other sellers would be shut down.

Another issue is that we can't get authorization certificates or invoices from Marvel anyway; we're not that kind of seller. If I had authorization certificates and invoices, I could upload and sell Marvel products. However, I uploaded a spider-themed product on amazon.com.

There was no Spider-Man or Marvel in it.

What would you do in my situation?

Find other products that you have or don't need authority to sell, only buy from authorised wholesalers or distributors, stock the products and don't dropship, as clearly this is causing you problems..

Dear Larry.

I do dropshipping on Amazon and find and add these products using Amazon SP-API compatible software.

Here's the situation: the spider theme on this product isn't just on Marvel products, it could be on many products; it's a trademarked product.

The seller in the US is selling this product, Amazon has authorized it, and sellers on amazon.co.uk can also sell it.

So there's no major problem with the product.

If there were a problem with the product and Marvel complained, other sellers would be shut down.

Another issue is that we can't get authorization certificates or invoices from Marvel anyway; we're not that kind of seller. If I had authorization certificates and invoices, I could upload and sell Marvel products. However, I uploaded a spider-themed product on amazon.com.

There was no Spider-Man or Marvel in it.

What would you do in my situation?

Find other products that you have or don't need authority to sell, only buy from authorised wholesalers or distributors, stock the products and don't dropship, as clearly this is causing you problems..
