Two Sellers using same ASIN for the same product

Hi - I’m a new seller on Amazon. I purchased stock from a Chinese supplier who also sells on Amazon. When I created the product listing on Amazon, I used the same ASIN as the Chinese supplier.

The Chinese supplier later got in touch with me requesting that I create the product listing under a new ASIN, even though the products are the same. My understanding is that Amazon doesn’t allow a different ASIN for the same product that’s sold by 2 or more sellers. However, the Chinese seller has raised a complaint with Amazon on the basis that I may have “violated the intellectual property rights of others.”
Now my items are blocked, even after providing evidence to Amazon of invoices from the supplier, proving that my products are genuine. Can anyone help with how I can proceed from here?

Regards,
Zabair

The listing should match the EAN/GTIN of the product, if however that particular listing is Brand registered and Trademarked to specific Seller you may not be able to list against it without an agreement, do you have an ASIN example?

You can very easily overcome this by buying a new barcode, then you can create a new listing and new ASIN.

The Chinese company has supplied you with a goods/a generic product but that does not mean they are permitting you to sell under their brand.

Eg. I can go to the Apple store and buy a brand new legit iPhone, but that does not give me authority to sell it online under the Apple brand as I have no been given express authorisation by Apple to sell items under their brand. It is the same case you are facing here.

Using a new barcode will allow you a new listing and ASIN where you can change any details you’d like to.

You can create a new ASIN but you cannot use the “EASYSMX” Brand or refer to that trademarked brand in the title or product details.

Does your product come with a branded box like this?

If not, then you are selling a generic product and need to create your own listing.

Hi, We emailed you in December last year, please don’t sell with our asin, and Tina also tells you that you need to create a new asin. Kind regards
