Taking Amazon to Small Claims Court

Hi all,

I’ve searched around but can’t seem to find an answer for this one.

We have a small legal issue and seem to be talking with a brick wall via Seller Support. We would like to open a claim in the UK “Small Claims Court”, as we are a UK-based company, but the issue stems from the Amazon US and Mexico storefronts.

Seeing as Amazon marketplaces are all technically the same company, will this work out, and has anyone done this before - ie. taken Amazon through the UK small claims court for an issue on a foreign marketplace?

Any advice would be appreciated.

No, you would not be able to make a claim against Amazon UK for Amazon US or Amazon Mexico, these are separate legal entities and therefore you have to take whichever entity you have a problem with to court in their own country.

This is one of the big problems people have with purchasing goods from China, when it all goes wrong its pretty much impossible to resolve.

its an interesting topic, and would appreciate an update if there is one.

I’m closing down my online business and have removed all the inventory over 6 months ago from every channel except the UK.

I still get calls to update the other channels to keep them compliant so investigated closing them down, but could only close the whole Amazon account and not able to close specific countries.

Interestingly, i couldn’t remove the payment card attached to the other accounts.

The one they use to charge for any money you owe them.

Usually, if the payment card expires, they stop disbursements until you add a valid card, but as the account has sat at 0.00 for the past 6 months, i looked at removing the card just in case of an unexpected debit and then i could determine whether it was fair or not and whether to pay or not!!

Its the little wins in life!!

I wonder, that if i did have a debit balance in one of the other accounts and no valid card on that account, is there a clause in their T&C’s that allow them to take it from your home account reserve?

I know they will not close the whole account unless all accounts are in good order.
