Listing Unbranded Items - Generic or my Seller Name?
Hi all, I have a various sample of items, all bought from abroad, unbranded. Most are unique / handcrafted or one-of-a-kind items that won’t be found anywhere else, or provided by a manufacturer as a sample, but unbranded. One example is a hand-crafted pen pot, made out of Hessian.
I submitted a GTIN exemption request and in the reply, Amazon told me I could use any SKU, but to list these as “Generic” for the brand. However though I’ve been reading on here that Amazon can then get arsey later on, despite directly telling people to use that as the brand.
Also I see other sellers selling things like these:

These all look to be sellers on Individual (non-pro) accounts like myself, however they’re selling these items under their own Seller name as the brand, so it says “By [seller]”, whereas mine says “By Generic”.
Do you think these guys have somehow registered a “brand” just for these random items? Or are they just winging it? Also what should I do? I’m currently going with using the “Generic” brand as instructed, but this does look dodgy to customers and would look far better saying “By Tritivum”.
If selling these few items goes well I’ll be looking to start a business and formally register a proper brand in the future, but while I’m testing the waters with these unbranded / unique items, it wouldn’t make sense right now.

I would say most of the other sellers are winging it. I sell some products which I see others selling with their own name as the brand, and in the title. Sometimes it’s an unbranded product, sometimes it does have a brand name on the packaging which the seller chooses to ignore. If I want to list against that product, I ask Amazon CS to edit the title to remove the seller’s name but I don’t always ask CS to edit the brand, unless the packaging clearly shows the original brand name. (I provide a photograph of my product as proof.)

Unless your registered brand name is imbedded on the product, or sealed packaging, then you can’t enforce any rights on others that may add their offer to your listing, the issue of adding your name may be a buyer thinking they are buying a branded product (your name) but receiving unbranded generic copies and could successfully claim as inauthentic, or not as described?
It’s a remote risk, but very possible on Amazon if a loophole exists for a freebie.
