It usually means someone has reported the item, usually the brand owners report intellectual property infringement

I guess the question is are you listing the item with the correct brand e.g the brand on the listing matches the brand on the product including the packaing

Do you have permission to sell the brand from the brown owners on Amazon, some brands allow you to sell their products but not via Amazon instead opting to keep that exclusivity on market places e.g Amazon to themselves

Hello Hair_and_cosm,

This is Zyan from Amazon, and I am here to assist you, I understand your concern about receiving a "Counterfeit without a Test Buy" complaint and wanting to understand what this means and how to resolve it.

I want to educate you on what "Counterfeit without a Test Buy" means. This occurs when a rights owner (brand owner) files a complaint claiming you are using their intellectual property without authorization. Unlike a typical counterfeit complaint where the rights owner purchases and tests your product, in this case they identified potential intellectual property infringement by reviewing your product listing, images, packaging, or product detail page without making a purchase. The rights owner noticed their brand name, logo, trademark, or other intellectual property being used in your product title, images, packaging, the product itself, or your product detail page. Amazon verified the rights owner's complaint and flagged your account accordingly.

To resolve this issue, please locate the violation in your Account Health page and click on the "Submit Appeal" option. You will have two resolution paths available: If you have authorization from the brand or rights owner to use their intellectual property, submit a Letter of Authorization proving you have permission. If you do not have authorization, click the submit button and review all available appeal paths provided. You should also receive a Performance Notification with specific details about the rights owner's complaint and the requirements to address it. Additionally, consider contacting the rights owner directly to discuss the issue and potentially obtain proper authorization if applicable.

Next Steps:

  • Check your Account Health page and locate the specific violation
  • Review the Performance Notification for detailed requirements
  • Submit your appeal with appropriate documentation based on your authorization status

The community and I are here to support you.

Regards,

Zyan

I am not doing well. I refused to repay someone who purchased a book from me on the 30th December only to inform me on the 18th February that they had not received it. Amazon, in their wisdom, overruled my decision not to give them a refund but kept their fee from me, therefore, I was out of pocket for the book, £9.99, their fee £4+ and my p&p £2+. How unfair is that. To make it worse I now owe Amazon money and will not receive anything for my other books sold. The person, in my opinion, was clearly not telling the truth as this is the first undelivered book in 20+ and why did it take so long to inform me that it had not been delivered. Why are we not allowed to make our own decisions about refunds and if they disagree why do they keep their fee??
