Brand registry declined
Hi there
I applied for Brand Registry in the UK and it’s been declined due to:
- The design or device mark image provided doesn’t match the image in the trademark record.
- The trademark image provided doesn’t match the image in the trademark record.
We require a matching image to associate the trademark with your brand name.
The trademark image provided is identical to the image provided and the image in the trademark record, so I don’t understand why it’s been declined? Has anyone experienced a similar issue or can offer some assistance? I’m the registered owner and the company is in my name.
I applied for Brand Registry on the same day that I registered the trademark, could that be a problem?

If the mark wasn’t searchable on the IPO website, then yes that probably would have caused an issue. Is it shown now if you check?
How have you shown your mark to Amazon - as an image or on product packaging?
Generally as I understand it - Amazon are looking for marks that are actually text. An image can be an image of text and therefore has a text value but it would need to match exactly. Usually the IPO will assign an equivalent text string to such an image mark.
