Product recalled by manufacturer

my product was recalled by manufacturer although I do manufacture my own product under my own registry number and brand name and I haven't recalled anything , this is costing me thousand of Euros to recall all the inventory from Amazon FCs and also a shipping that is already on the way to Amazon warehouses right now that costed me another thousands of euros , it seems that anyone can scam Amazon support as the manufacturer without any proof and sabotage another seller product and let them pay for it . I need to understand how this issue can be resolved since the support team seems not to care about any business loss or impact .

This doesn't make sense.

Who manufactures this product, you or "the manufacturer"?

What was the recall regarding?

Does the product you manufacture differ from the one the manufacturer manufactures or does it exhibit the same issue that has led to the recall? (confused)

If a recall is necessary, then the impact to your business is irrelevant. This is why insurance is advised. For exactly this reason.

As above - it isn't clear what has actually happened.

Hello @Seller_cFJJwh38zMHWi,

Thank you for reaching out.

I am investigating your case. When was this communication sent? Is it shared in a SPS case? Can you see it in the Performance Notifications?

Kind regards,

Julia.

Just for clarification, when you decided to sell this product, did you provide all the documents, which are now requested again?

The thing is going to be this, if you are selling a private label product, then as the deemed manufacturer under UK and EU law you are responsible for ensuring that the items meet the required safety standards.

If your product is similar but not the same, then you should have or be able to obtain the required safety testing documents which prove your product is compliant.

I am not defending Amazon, but they have a duty to remove any potentially unsafe items from sale and if your item has been flagged, its a simple case of providing the required documents to them on appeal and the item should be reinstated.

Is it ideal ? no. But whenever you private label an item you become legally responsible for ensuring the compliance of the item

If the item is the same and is a risk, then it should be returned and destroyed by you and any recall issued to affected parties.
