Product Liability Insurance

Hi,

Does anyone know if we are required to obtain a Liability Insurance when we are not the producer of the products that we are selling?

We are doing wholesale in EU and UK marketplace.

Thanks

You can be held liable for products you sell, regardless of whether you are the ultimate manufacturer. So it stands to reason that you should have adequate insurance coverage.

Hi @Seller_d5STcDUwj8ZoP,

Yes, you do need liability insurance for wholesale products you’re selling in EU and UK marketplaces, even if you’re not producing them yourself.

Here are the key points to understand:

  • Amazon requires all sellers to obtain commercial liability insurance within 30 days after exceeding USD 10,000 in gross proceeds in sales in one month on Amazon.com, or if otherwise requested by us.
  • This requirement applies to all products you list for sale in the Amazon store, regardless of whether you manufacture them or not.
  • The policy must cover all sales from products you have listed on the Amazon store.
  • The policy limit must be at least USD 1 million per occurrence and in aggregate, covering liabilities caused by or occurring in conjunction with your business operations, including products, products/completed operations and bodily injury.
  • The policy must name “Amazon.com Services LLC and its affiliates and assignees” as additional insureds.

It’s important to note that these requirements are designed to protect both you and your customers in case of any incidents related to the products you sell.

Regards,

- Manny

I looked into this today and was ready to buy some cover at just £15 per month with Churchill but hit a snag when going through all the details with the insurance company on the phone, it said that if the items (Electrical items that i sell. Games consoles) are not tested to official standards, then the cover would be void

So left it for now and looking into the proper testing protocol, may even pay for a course to become an official PAT tester myself

My concern though is how easily Amazon will grant claims because if its anything like how easy they grant refunds on the word of a customer... Then this will become the final hurdle that just makes it pointless selling on here anymore

I have been selling consoles for 13 years on here on and off and never had any issues (industry wide these issues are very very rare) but already since the change in law last October, I now have somebody telling me that a console i sold him hard burned his sons arm and given him trauma (Even though he was willing to just drop the claim in his 2nd message to just be refunded on the item)

Got me worried this :(

£15 per month? Sounds crazy low I pay over 200.

Is it a full products and public liability insurance policy?

My current policy is an Amazon specialist insurer but theres a list of product exclusions including electricals, medical products etc.

I thought that and expected it to be more but it was not void anyway unless i had each console pass a safety test performed by a 'credible person' or something?

The £15 p/m covered for 2million and did come from a quote site, who's link was in the Amazon email suggesting i get the cover

I think is for full products yeah. Maybe you just sell a lot more though
