FBA Private Label Brand Name

Hello everyone,

I am a new seller looking to get started selling on Amazon FBA & have a few branding questions.

I am looking to purchase from a wholesaler such as Alibaba with the intent of private labeling the products to sell on Amazon.

When creating a UPC on GS1 it asks for a brand name. If I created a name, such as "crafty tools", would that have to be trademarked and would I have to submit for a doing business as (DBA)?

If so to either of those, is it recommended to list your brand name as generic to start?

I have heard brand registry and the trademark process and lengthy and can be costly. For a new seller just starting out, is there a course of action that allows me to sell without having to complete all of this?

Side question, is it recorded to get your supplier to sign a contact with you indicating they allow their product to be resold? S

Welcome to Amazon! My name is Sandy from the Community manager team on forums. Please see my responses below.

If you are working with Alibaba, To create a true private label, you'll need to work with suppliers to customize the product with your brand logo, packaging design, etc. This means that you will need to have an agreement between the supplier and yourself that they are manufacturing your branded products. Please note than an invoice will not be approved as an "agreement."

It's also important to note and research that you are not selling counterfeit goods from established brands. Please always check with suppliers about intellectual property rights before purchasing.

Brand Registry requires all sellers to have a trademark with governmental offices. You can read more of the requirements here.

Additionally, some sellers to decide to post as "generic" and post under their brand name once approved. However, please note that when doing this, it is considered a brand name change and not supported to rename from generic to your brand name. Sellers will have to create new ASINs under their new brand name.
