Amazon requiring manufacturer name and address on packaging

Hi

I was hoping someone could help me ASAP please.
I am about to sell a toy through FBA. Everthing is in place and just waiting for delivery of products to fba centre.

However my listing suddenly had been disabled with amazon asking me to prove the manufacturer name and address are on the packaging???
I know of very very few toys and toy packaging with name and address of the manufacturer on packaging and despite several messages and calls to seller support, they keep saying the same thing over and over again like a bunch of robots who don’t seem to understand what I am trying to say.
My product does not have the name and address of manufacter on the package - like many many more.

What can I do please?

Here is the message from amazon:

Thank you for your interest in selling Toys on Amazon. We’ve reviewed the information you provided and determined that it does not meet our requirements. To allow us to continue processing your application, please address the following issue(s):

  • The images provided are unclear and the text is illegible. Please provide legible images reflecting each side of the product packaging.

  • The images provided do not meet the EU labelling guidelines, which state that the label must contain the business name and address of the manufacturer. Please provide product images that meet this requirement.

Please respond to this case by providing documents that remedy the issues described above. Please ensure that the documentation you submit meets the following requirements, as applicable:

Image of the label or Product Packing Pictures.

Document must meet the following requirements:

Contain name of the manufacturer
Include product, trademark, or model number
Must include all sides of the packaging
Include a live photo of the product you are trying to sell, rather than a computer generated version

I’m no toy seller, but to my knowledge, this is an EU-wide requirement.

Importers may only place toys compliant with safety requirements on the EU market. An importer has to take the following steps:

  • Ensure that the manufacturer has carried out the appropriate conformity assessment procedure to demonstrate that the toy complies with essential safety requirements.
  • Ensure that the manufacturer has drawn up technical documentation that shows the toy complies with the essential safety requirements.
  • Keep a copy of the EC Declaration of Conformity that states the fulfilment of the essential safety requirements has been demonstrated. By drawing up this document, the manufacturer assumes responsibility for the compliance of the toy with safety requirements.
  • Ensure that the CE marking is affixed either directly on the toy, on an affixed label or on the packaging.
    *** Affix his own name and address.**
  • Ensure that the manufacturer has affixed his name and address, as well as an element allowing identification of the toy for traceability (e.g. a batch or serial number).
  • Ensure that the toy is accompanied by instructions and safety information and bears the required warnings.

Sorry to inform you… After complying with every single thing they asked if me, producing tons of evidence, and by the way, everything is 100% legitimate, with not a single grey area in my business, they rejected it and gave no indication as to what the problem is.

I have ceased trading with them since then until I figure out something else.

I guess this is going to affect more and more people. I am looking to sell in the UK and we are leaving the EU but imagine that Amazon will continue with it’s own standards.

I think during C19 they have really let support slip. I wonder if 6 month down the line when they see less and less sellers able to list then they will check back and find out this is going on.

I find the Indian support team very unhelpful (this is being very generous I could say a lot worse).

If you run a business and rely on Amazon then you are at risk such as myself.

I am now having to sell through other platforms.

I would also dispute this is an EU requirement.

There I just said it to the brick wall in front of me.

I have exactly the same issue, not a toy but beverage. And our company name + adress is mentioned clearly on packaging. Only get computer generated reply with no chance to get in touch with an actual person to figure out what is wrong.

Our product is co-manufactured by a company in Austria but we are the brand owner. It says “Produced in Austria” then our Ltd company name and contact address.

My company is NZ registered, our goods manufactured in China.
We have recently started selling on Amazon US, and are now getting hounded about compliance.
The one we can’t easily pass is taking a picture of packaging containing the manufacturers address (because we don’t have one printed on it!).

We sell playing cards, which are hardly dangerous toys, and previously after some back and forth, AMZ just ‘moved my listing to a more appropriate category’, and the problem went away!
But then, other listings started causing trouble, too.

I’m getting a reprint done, and considering packaging moving forwards that is compliant.

I’m basically looking for the cheapest, least hassle solution.
I am hoping that using a virtual address (purely for correspondence, and mostly to please amazon’s requirements) would do the trick.
Then would write somewhere along the lines of: Produced for (My CO). Contact in US (my virtual address, phone number email, web) somewhere.

I’m struggling to confirm whether A: I’m opening up a whole new can of worms by doing this (i.e. does this impact tax or regulations or something?).
B: a virtual address is OK for these contact purposes, as far as Amazon is concerned,anyway.
and C: if using a permanent sticker vs hard printing onto the box is OK, as well (because the US is not my only, or main market.

Any advice appreciated!
