Exclusive agreement
Hi everyone,
I am hoping that someone can help.
A brand is offering me exclusivity to sell their products but they find it unprofessional if we sell under our own account and not under their brand name. Is there anything I can do other than them having to create a separate seller account?
Thank you

Surely you can sell under your account using their brand name?
or do you mean they want you to name your storefront with their brand?

Agree with dedez. If you want to brand the product in your name, I’d side with the supplier, but if they want you to rename your store front they can set up their own amazon store!
I mean that would be like Heinz insisting Tesco rename all their stores Heinz to sell Heinz beans

Also the usual issues with separate selling accounts will apply here, an issue with one account, if there is a link between the two could mean both the accounts are closed.

You need to clarify with the supplier too the workings of amazon
Let’s say you are rabanne ltd at the moment for your own store
Your suppliers products are branded - bestproductever
They want their goods listed , branded and sold by bestproductever
The new ltd company is say rabanne 2 ltd
Is their trademark in the name bestproductever ?
If so, the brand registry will have to be bestproductever
But can you also name your storefront bestproductever ? You’d need to check it’s available
I don’t know as I don’t deal with brand representation or agents but hopefully someone else can answer

The Little Shop is correct in terms of getting the brand owner to set up a brand registry account and appoint you as the administrator. Unfortunately though, this will not give you exclusivity. It will allow you to create listings and edit them, images etc, which normally is hard work / impossible, if there are multiple sellers. Amazon will not though, take other sellers down, or potentially prevent new sellers jumping on. To be fair to Amazon, it isn’t their remit to enforce contractual agreements of third parties, so I do understand their stance on this. We have been in a similar situation for almost 2 years on one of out ASIN’s. We do get human contact, as we have a marketplace assistant, so hopefully understand this scenario quite well. Ultimately, the only way to get exclusivity is to own the IP, but if that’s not for sale then the best option is to follow the Little Shops advice. Good luck.
