Conterfeit Item

We have been selling on Amazon since around 2016, we opened our shop with the name Hmhome, all the products are simple gifts made by us from home. When Amazon started to really push Brand registry a few years ago they locked in our products as Hmhome Brand even though we had not applied for intellectual property at that time. This started to cause a problem as we couldn't update our listings ect. So we applied for Hmhome and was denied ownership of this name due to dispute from the much larger company H&M. We continued to sell under Hmhome as we had some nicely positioned listings that we didn't want to lose, we have since registered a different brand name that we are in the process of building.

Last year we noticed some other sellers had gained access to our top 20 listings and started selling our products, we tried to get them removed but had no success. One of the sellers has now changed some of the details on the listing to show that he is manufacturing the items and claims the he is the rightful owner, one of our listings has been deactivated and we are currently trying to prove to Amazon that we are the rightful owner of the product we have listed under Hmhome, Other than being the creator of the original listing in 2019 and years worth of sales we do not have proof of ownership. Is there anything we can do to stop these items being hijacked?

Contact Seller Support directly through your Seller Central account and explain your situation. Provide evidence that you are the original creator of these listings from 2019, including your sales history and any documentation showing you created the original product content.

Report the unauthorized changes to the product detail pages. On each affected listing, you can select "Report an issue with this product or seller" and choose "Some product information is missing, inaccurate or could be improved." Explain that another seller has incorrectly modified the listing to claim they are the manufacturer.

Consider your new brand name for your products. Since you mentioned you've registered a different brand name, I recommend transitioning your products to this new brand as quickly as possible. This will give you Brand Registry protection going forward and help prevent similar issues.

Hmhome is nothing like H & M - who would get the 2 confused?

Have you been to a Trade Mark Wizard dispute Company, as they can assist.

You have applied as a brand owner with Trade Marks etc and H & M raised as an issue and you got a lawyer or someone involved?

Are your barcodes purhcased for GS1? If so, this is good.

I would register the trademark hmhome ASAP - very quick to do, and not expensive. Then go through brand registry.

Other than that, you can make purchases of the counterfeit products, raise a claim as counterfeit (as not made by you, they are not genuine), which causes problems for the seller. We often do this, but we are brand registered.
