CE Mark - who puts it on the product?

Hi. I am new to this so not sure about it.

I have ordered some toys from a manufacturer in China and I’m trying to get them shipped over.

I need to become ungated first and Amazon are asking that the CE mark be put on the product.

  1. Is it ok for this CE mark to be put on the label that accompanies the product?
  2. Is it best that I unbrand the label from my company name? What liability is there for my company name to be on there?
  3. Is there a legal responsibility for the manufacturer to place the CE mark on the product?

The ce mark needs to be on the label permanently fixed to the product

Your company name and address need to be on it

There is a legal responsibility for YOU to make sure they have been ce tested

As a new seller you may find it difficult to be ungated in toys and games. Have a search through this forum

You really need to read and understand the Toy safety regulations yourself. The penalties for selling dangerous toys, or even just ones that aren’t tested and marked, are very severe: fines of up to £5000 and/or 6 months prison, which can be for each offence, so 10 different toys £50,000 fine and 5 years in the nick. Civil damages if you actually cause harm to a child can literally be unlimited: if the child needs full-time care for the rest of its life, that would be millions

Be aware also that many Chinese manufacturers use a deliberately misleading China Export mark that looks almost the same as the EU/UK marking or will fake EU documents

No.
The CE mark is a sign the toy / item has been tested for safety - to meet the safety requirements for the EU (and UK) .
Chinese products may not be safe.

Cancel it and do yourself a favour and read all the other threads from people trying to import unsafe toys from China.

The CE mark has to be permanently attached, if you read other threads, a sticker will not suffice.

Not only does your company name (and address) have to be on there as the importer you will also need an EU address.

There probably isn’t a legal responsibility in China for anything to be tested at all but, if you want to sell it in the UK, then yes, it is a legal responsibility for it to be tested and a legitimate CE mark applied.

You will need proof of the testing, it isn’t (as somebody else on here thought) just a case of buying some CE stickers and, as someone else pointed out, the Chinese have a deliberately misleading ‘China Export’ symbol which you should not confuse with the European Conformance CE mark.

According to the information below not all products need to have CE Marking.

What if a product is not CE marked?

If no CE directive or regulation applies, the General Product Safety Directive (2001/95/EC) may apply. This General Product Safety Directives requires that products are safe, but is does not require any marking

However Toys is one product categories that will require CE Mark.

I’m the OP. Got to admit this has been a steep learning curve for me. Lesson learned. The manufacturer has agreed to a refund so I’m not too far out of pocket.
