IP Design Complaint Abuse – 64 Days Without Resolution
Hi Amazon team,
I believe I am a victim of design right abuse and I’m requesting urgent escalation. Reposting into correct section of forum.
A competitor filed IP Complaint ID: 11153945292 against my product, and I have been fighting to have it overturned since 30 May — that’s now 64 days without resolution.
To support my case, I have submitted the following:
- A copy of my valid UK registered design
- A comparison document clearly showing the differences between my product and theirs
- Evidence of my direct communications with the UKIPO, who confirmed my design is legally distinct from theirs
- A formal letter from my solicitor, who independently reviewed and verified all documentation and confirmed I am lawfully entitled to sell the product
- Proof of sales on another platform I had which is dated weeks before their patent was even filed.
Despite this, my listing has remained in review with no update for over 2 weeks for my appeal. The IP complaint appears to be a bad-faith attempt to block competition.Please could this case be escalated to the appropriate internal team as a matter of urgency?

I’m pleased to confirm the case was closed in my favour on Friday and my listing has been reinstated. Am I right in assuming this means this ASIN is protected against any further action from the other seller going forward?

I have just received a new IP claim from the SAME seller for the very SAME ASIN (new complaint ID: 11442197132).
With my comprehensive evidence and your support, I previously won the original Amazon IP complaint. At that time, I specifically asked if I would be protected against future IP claims from this seller, and you confirmed that I would be.
It is therefore clear that I am experiencing seller-on-seller abuse, with repeated and unfounded claims being used to disrupt my business. I would appreciate your urgent help in ensuring this complaint is removed quickly and that stronger action is taken to prevent this seller from continuing to abuse the IP complaint system against me.

I got an email about 30mins ago stating “We received your submission but do not have enough information”. Do you have an update on this escalation? As I’ve already provided everything in the original claim which was successful.
My concern also is that this seller is repeatedly filing unfounded claims, which puts my account health at risk. Could you let me know what steps Amazon can take to prevent this from becoming a weekly occurrence?

@Julia_Amzn Sorry to chase, but this has now been almost 3 months where I’ve been unable to sell this product. Could you let me know if there’s been any progress on your escalation?
I’ve received an email stating: “We received your submission but do not have enough information.” and asking for permission from the person who filed the claim. But i've already proved this is my product and design rights. I'm not sure if this was just an automated email. I’m concerned, as I already provided full documentation in the original IP claim that was successful.

@Julia_Amzn Sorry to chase — is there any progress on the escalation? . I already won the original IP complaint against this seller, and this new claim is just a duplicate done to stop me being able to sell this product.
All evidence was previously reviewed and accepted, so I’m not sure why I’ve now received an email asking for more information. My concern is this seller keeps filing duplicate claims to block my listing. What can Amazon do to prevent this repeated abuse?

I’ve literally just had the same experience. A competitor issued a take down notice to Amazon on the grounds of Infringement. My listing was closed for 8 weeks right through my peak selling season. Several appeals and solicitors letters later Amazon just re-opened the listing with an email saying ‘occasionally Amazon err on the side of caution, sorry for any inconvenience caused’ !! That 8 week inconvenience cost me £200k in sales, £4000 in legal fees and £6000 in recalled inventory fees as Amazon sent back all inventory due to going over the time frame to resolve. I appealed the recall fees as a gesture of goodwill on their behalf as they took 8 weeks to decided that the take down notice was unjust causing the case to ‘run-over’ but that just fell on deaf ears.
It’s terrifying that a competitor has the power to do this and that Amazon take so long to realise there is no case to answer to.
