Am I allowed to Sell on someone elses listing?
Usually when I start a new listing, I create a new EAN number and sell it as my own product, but if I search the catalogue when adding a new item, I can sell on other seller’s listings.
If a seller has sent many items to FBA, and I come along, undercut his price, and win the buy box, what happens to the other sellers stock? it just seems a little harsh to do that to another seller.

Apparently he has a brand, but it’s a generic unbranded item.
I hope someone can clear this up for me as I don’t want to do something that’s against Amazons terms.

No. It isn’t complicated.
If your invoices and products don’t say Stormshopping on them then Qian Jiang Shi Feng Bao Gou Dian Zi Shang Wu You Xian Gong Si will rightly file a counterfeit without test-buy against you with Amazon, who will suspend your listing until you provide invoices and/or a letter of authorisation from the brand owner (Qian Jiang Shi Feng Bao Gou Dian Zi Shang Wu You Xian Gong Si) allowing you to sell that branded item.

I mean if you’re compassionate about it then yeah I suppose it is but it’s a be eaten or eat world. They’d do it to you. Amazon is the business of money making not making friends with competitors

The item may be generic, but they have branded it their own so if you list on it, it’ll be likely they send you a long message telling you to get off it as it’s branded to them & yours won’t be.

this is my confusion, am I allowed to sell on this listing or not? How can the seller decide to be a brand just because he says he has a brand name? there are protocols to follow to become a brand.

if these are generic items the other seller will have registered a trademark and applied for brand registry
unless the listing has the brand name as generic, you cannot list on it

It seems the meaning of ‘brand’ has changed a lot in recent years (partly thanks to Amazon).
At one time it meant a name you could trust to supply a certain level of quality.
Now it’s just a random name you stick on generic Chinese imports…

Personally, I wouldn’t do it.
From the little bit of research I have done, legally speaking if the product you are selling is the same product as the listing from the same manufacturer, then your allowed to sell on that listing regardless of the brand name as it would be considered a ‘white label’ product.
However what’s legally allowed and what you can do on amazon can differ. So if that seller whos listing you have listed on registers his brand and kicks you off the listing you will likely get a performance violation having a negative impact on your seller account which really is an unneeded headache for anyone regardless of if you can resolve it or not. Which I believe you could if you supply amazon the necessary documentation proving it is a white label product.
However morally its wrong as someone has gone through the time and effort to make the listing, so I personally wouldn’t do it, you could also make an ‘enemy’ who could take some unsavoury action against your seller account which I won’t go into the details of but I’m sure many will know what I refer to and it probably happens more often than not but hard to prove. So even if you win you lose.
Save yourself all the trouble and get your brand registered. It may cost you a few bob but it’ll be the best decision you will make in terms of longevity of your amazon account. You would need to make an account with GS1, register your trademark with the IPO and
register your brand with amazon.
