We have been unsuccessfully appealing a design right issue of Compatible Apple Watch Bands and would be grateful of assistance.

After seeing many sellers listing watch bands compatible with Apple Watches, we bought some through a Chinese supplier to list on the market place. Unfortunately our lack of IP Knowledge meant that we didn't research potential infringement of design right. Subsequently Apple Inc raised a complaint which has resulted in a selling suspension. We have accepted the violation and take full responsibility for our naïve mistake due to lack of knowledge of intellectual property and design rights.

We have since researched information on Gov.UK IPO and amazon IP policies Seller University, which has educated us on the infringement. We now understand that the straps were a direct copy with no deviations from the registered Apples Design Right Registration on Gov.UK IPO.

We have completed the tick box questionnaire to accept and take full responsibility in account health and the account health is green and at200

We have submitted multiple appeals and consulted with account health specialists who advised that the appeal is strong. The appeal covers the following categories.

Root cause :lack of IP knowledge and and amazon policy and failing to request licenses or proof of eligibility)

Corrective measure: Removing the listings and destroying the inventory.

Preventative measure: Education of amazon policy, understanding intellectual property policy, ensuring that product suppliers can provide documents of compliance.

Each time the appeal has been rejected and then a different account specialist gives a different reason and more advice. We have covered many variation of the appeal but no success.

We don't understand why and when we ask the specialist the full reasons they say that they do not actually know how the internal team validate the appeal so they can only guide.

We are running out of ideas.... can we please get some help.

I would really appreciate if anyone could help me with this issue i have been facing for the last week. Im just going round in circles here and amazon isnt willing to help.

My listings have been incorrectly deactivated due to an alleged Patent Infringement.

The complainant, does not hold a patent for the product in question. They only possess a Registered Design number, which is distinctly different from the design I am selling.

The complaint was filed as a patent infringement, but no patent exists. This is a fundamental error in the basis of the complaint.

Even if we consider the Registered Design, my product does not infringe upon it.

The deactivation appears to be based on a misrepresentation of the type of intellectual property involved (patent vs. design right) and an incorrect assessment of similarity between the designs.

Has anyone faced similar issues, if so please could they share how they overcame this issue?

I have applied to invalidate the registered design at the UKIPO as this design has been available on amazon for sale since 2019 and was only registered in november 2023.

I am not sure what else i can do, seller support keep directing me to account health and account health just keep writing back to me with the same generic response. every time i appeal.

To add insult to injury there are over 20 asins selling the exact same product on amazon, this seller has targeted me individually.

I would appreciate if one of the moderators on here would take a look at this as well.

A competitor has removed several listings of our with a false design right infringement

We have replied to Amazon with the evidence that we actually own the design right to our products with the evidence, numbers, certificates and images showing the clear differences and the difference between our products design and the competitors and Amazon as usual just reply with the standard bot response that they need more information.

We have literally provided everything.

It is so frustrating, this is where Amazon is broken
