Trademark Logo Misuse

Hi,

AMAZON have pulled a number of my listings as they state they are Trademark misuse. The products are SQUIRE padlocks and SQUIRE is also an electric guitar company so apparently this is an issue as I am mis-selling the padlocks… the company brand and name is HENRY SQUIRE but they call themselves SQUIRE so we list them as this.

We contacted them and they told me to change the brand names and title which I have done but now they are saying HENRY SQUIRE is not a valid name…

The products are PADLOCKS from Henry Squire and we have their direct permission on a letter of authority to sell all their products which we have shared with them. AMAZON says that this brand name is an invalid brand name even though this is their company name.

How can we get some sense on this as we are being told that we can not list these items and this is massively impacting my account health

any help would be appreciated.

Send them the link to the squire padlocks trademark.

Although your title says logo, is it something on an image?

Robot will definitely get confused by two trademarks in the name of “SQUIRE”, thats what robots do. However, tm law is such that, if the marks are issued in the same territory (UK), they will be in different classes. The tm that you are using for instance is in classes, 6,8 & 20. If you point this out to Amazon, hopefully a human being will get involved, though that’s quite an ask. You can however prove that the tm’s that you are using are wholly legitimate, even though you dont own them ;

SQUIER is actually the guitar brand, which is american and owned by Fender. Have you possibly miss-splelt something somewhere on one of your listings ?

thank you for your replies these are great.

The spelling of our padlocks is correct ( SQUIRE) and your correct the other brand is spelt Squier so not even the same thing!! I wish AMAZON had a bit more sense and would work this stuff out.

I will get in touch with them again to point this out and hopefully this will clear up the issue
