Please Help With my POA for IP section 3

Hi, please help me here as I’ve tried so many times but I always get the same reply for more information.

Short about me. I'm sole proprietor, selling only wall stickers. I'm making designs and printing it by myself with professional printing machine, I don't have any suppliers - suppliers only for materials (printing paper, paint and packaging materials). One day I found on Pinterest nice wallpaper and made a wall sticker based on it. After this I'm created listing on Amazon with this design, couple days after this I got performance message that my account deactivated. It turns out the picture had Fortnite characters in it :/

This is one of the many POA I submitted, all of them slightly different, but none of them good enough.

The Root Cause

This Copyright Infringement is completely my fault and I do not believe it’s a mistake, I take 100% responsibility for the issue, I made the mistake.

Epic Games is the Fortnite rights owner whose characters I used on my listing for the following ASIN: B0FB9DNDTK

  • I should have been more aware of Amazon’s product and listing policy requirements and verify my listing process against those requirements before creating the listings.
  • I should have been more aware of Amazon’s product detail page rules as well, and not including copyrighted images in any of my listings.
  • I also failed to verify authorization with brands or notify them of my intended Amazon sales prior to listing and selling the products on Amazon.
  • I should have checked the UK IPO, USPTO websites for images used before creating the listings.
  • The process used for creating the listings that caused the violation was based on the designs I receive from the Pinterest, and in this case the design had the “Fortnite” characters.
  • Consequently the design was added to the items, and moreover the characters “Fortnite” used in the main listing images.

The actions you have taken to resolve the issue

  • I have carefully reviewed my entire inventory to make sure that all my listings meet the program policy and product guidelines outlined here (https://sellercentral.amazon.co.uk/help/hub/reference/G521), (https://sellercentral.amazon.co.uk/help/hub/reference/GYTR6SYGFA5E3EQC).
  • I checked the category, product, and listing restrictions guidelines (https://sellercentral.amazon.co.uk/help/hub/reference/G200253000) against my inventory to make sure none of my product is restricted.
  • I made sure my listings adhere to the selling policies and seller code of conduct (https://sellercentral.amazon.co.uk/help/hub/reference/G1801).
  • Double check the product detail page rules to make sure all my product details are in line with the rules outline here (https://sellercentral.amazon.co.uk/help/hub/reference/G200390640).
  • As a non brand owner I checked that my ASIN are in line with the ASIN creation policy (https://sellercentral.amazon.co.uk/help/hub/reference/G201844590).

The steps you have taken to prevent the issue going forward

  • Before listing any new products for sale on Amazon I will verify that the text or design don’t violate anyone’s intellectual property, trademarks, copyright or a patent by checking the UK IPO, USPTO websites for images I use on the listings. On the UK IPO and USPTO websites I will use the search function for images on the image search function. This websites will provide me the required information.
  • I will carefully follow the program policy and product guidelines found here (https://sellercentral.amazon.co.uk/help/hub/reference/G521), (https://sellercentral.amazon.co.uk/help/hub/reference/GYTR6SYGFA5E3EQC).
  • I will carefully follow the page rules (https://sellercentral.amazon.co.uk/help/hub/reference/G200390640).
  • As of September 12th, and on the 1st of each month moving forward, I have also established once-a-month session on Intellectual Property Laws to better understand the topic and eliminate the possibility of future mistakes, thus making sure Amazon.co.uk should not receive any more copyright infringements on my behalf.
  • I’m keeping a database of all the images that could potentially be registered and Copyrighted in the future on a Google doc that gets updated every time a new product is upload, and perform recurring checks for each listing on the UK IPO, USPTO websites by searching for the images using the UK IPO and USPTO search function. Any newly registered item will be deleted from my inventory immediately.
  • I re-read and will follow Amazon’s Intellectual Property Policy from this link (https://sellercentral-europe.amazon.com/help/hub/reference/external/201361070). I’m now clear as what an intellectual property is and the difference between Trademarks, Intellectual Property and Patents, and why I wasn’t allowed to sell the item as I didn’t have any permission to do so.
  • I will read Amazon’s policies once a month, on the 10th of each month, to ensure that I am not in violation of any rules, and I will monitor all changes to the policies or any applicable laws, which could affect me or my account and react proactively. This step will be done by logging in and reading through the policies on a weekly basis, and by keeping notes and noting down any changes. If I find any changes I will act accordingly and modify or delete my listings as required by the policy changes.

I believe that this plan sufficiently addresses the issue and hope I will be able to continue selling.

I appreciate the privilege to work with Amazon and will do everything it takes to keep the customer’s trust. Hopefully, you will consider my effort and reinstate my Amazon Seller Account. Thank you for working with me on this issue.

I’m afraid the only way to resolve this is to ask the complainant to withdraw their infringement complaint against you - in writing g to Amazon quoting g your merchant number.

I understand this is difficult news, but I need to be clear about the situation with your Section 3 violation.

Unfortunately, in these cases, only valid brand invoices can resolve the issue - no other form of appeal will work.

While I truly wish there were other options available, I must be honest that without proper brand invoices, we won't be able to reactivate your account.

I know this isn't the news you were hoping for, and I sincerely empathize with your situation.

  • I re-read and will follow Amazon’s Intellectual Property Policy from this link (https://sellercentral-europe.amazon.com/help/hub/reference/external/201361070). I’m now clear as what an intellectual property is and the difference between Trademarks, Intellectual Property and Patents, and why I wasn’t allowed to sell the item as I didn’t have any permission to do so.
  • I will read Amazon’s policies once a month, on the 10th of each month, to ensure that I am not in violation of any rules, and I will monitor all changes to the policies or any applicable laws, which could affect me or my account and react proactively. This step will be done by logging in and reading through the policies on a weekly basis, and by keeping notes and noting down any changes. If I find any changes I will act accordingly and modify or delete my listings as required by the policy changes.

I believe that this plan sufficiently addresses the issue and hope I will be able to continue selling.

I appreciate the privilege to work with Amazon and will do everything it takes to keep the customer’s trust. Hopefully, you will consider my effort and reinstate my Amazon Seller Account. Thank you for working with me on this issue.

Unfortunately, in these cases, only valid brand invoices can resolve the issue - no other form of appeal will work.

While I truly wish there were other options available, I must be honest that without proper brand invoices, we won't be able to reactivate your account.
