actual robbery

A customer purchased nearly £100 worth of stuff and wanted to return one of the items but missed the returns period and opened up an a-z claim. I said we would send a free returns label and honour the return. In the meantime Amazon refunded the whole amount so basically the customer now has £100 worth of clothing for free. The customer stopped replying to messages. I have tried contact the obudsman but they have said they cannot help as it is amazon who need to sort. I have got nowhere with amazon and just get the same automated reply 'we stand by our decision'

So if you think you are covered you are not! As amazon will rob you anyway!

At this point, the buyer would need to inform Amazon customer service to reverse the refund of the claim. Amazon cannot reverse a customer refund for seller-fulfilled orders, without the customer's affirmative consent.

Yes, you claim for all associated costs, including the court fee and other reasonable expenses.

I am wondering if they cover the court fee in that case or not.

You need to pay the court fee up front and you will get it back if you win.

But you won't if you lose.

So it will not cost me to take them to a small claims court?

Yes - but if successful you can claim the court fee costs and reasonable costs you incurred in bringing the claim (eg your time, cost of sending letter before action etc) Most small and straightforward claims are now dealt with online - a recent one we raised was dealt with in a conference phone call with judge and "buyer" Was stress free - just flll in the online form and attach what evidence you have..

Send a letter before action first. Its the cost of a tracked letter (google an example) DO NOT send it signed for - just tracked with delivery confirmation since serial fraudsters will not sign for it. Keep a copy and use it as evidence if you need to file a claim that you have tried prior to court to obtain redress

"In England and Wales, the cost of making a small claim is a court fee that depends on the amount of money you are claiming. Fees range from £35 for claims up to £300 to £455 for claims between £5,001 and £10,000. For very large claims, the fee can be 5% of the claim amount or a maximum of £10,000. If you win, you will usually be awarded these fees back from the other side."
