Vat returns in Germany

After making many calls, filling in forms (more than once) we finally have our German Tax Certificate. Fine, but now they say deadline for tax returns have expired and we might be fined…….but we have only just received our Tax Certificate??
Notwithstanding the above, the goods we sell are zero rated for vat in the UK………will this also be the same in Germany?? We have been selling in Germany since Feb 2018 and have never charged vat.
Having looked on several “advice” sites it looks like we have to submit monthly returns now, and have to download ELSTER which is the German way of filing vat online.
I would also say that our sales in Germany are a modest 1,000 euros per month, so beginning to wonder if all this hassle and form filling is going to be worth it!!
Sorry for the multiple questions but advice needed, and maybe even professional advice

I would definately get professional advice as they have mentioned possible penalties - but not from this forum!!

One thing - i dont know what you sell but Germany (and other non UK countries) rate products differently for VAT eg kids clothes, shoes etc are nil rated in Uk

very much depends on if you stored your items in Germany or not…
As soon as you have one item stored in a german warehouse (e.g. FBA) and sell to a german customer, you have to apply for a VAT number, file tax reports and pay taxes to german tax authorities.
So if you have done so already in 2018, that tax report is missing.

Professionell help is highly suggested.

This is just based on my experience submitting DE VAT returns and definitely not professional advice.

Once registered with the German tax office for VAT in Germany you then need to submit monthly and annual returns. The monthly returns need to be submitted by the 7th of the following month (it is rather draconian time frame). Failure to submit, results in I think in 10% penalty of the VAT payable. They also charge interest at 1% per month on outstanding VAT unpaid. They will also estimate your returns if not return is submitted and charge the penalties based on this. Once returns are submitted these will be corrected.

Your correct that Elster is the platform for submitting returns. It also involves an annoying process that to register you receive an email and then you must wait for a letter with a code to authorise this. If you are using the file upload to authenticate log ins then it is essential to keep this file on the computers you need it on. One of my computers recently died and was the only computer the file was stored on.

With regard to VAT rates, standard rate is 19%, categories of goods and services charged with reduced VAT rate of 7 % are Water supplies, medical equipment for disabled persons, local public transport, books, newspapers, periodicals, hotel accommodation, social services, firewood, take away, cut flowers and plants. You may therefore find that when selling an item to Germany, now registered, it may be VATable where in the UK it may be exempt - kids clothing for example.

In terms or submission you need to send proof of sales - these can be attached to returns - my German isn’t very good so I didn’t - the German tax office contacted me and asked me for Amazon screenshots and reports to prove the total and also queried why the Amazon total to my returns varied. Generally 30% of our sales are not within Germany, with the majority going to Austria.

I am just completing my first German Tax return on Elster. I wonder if you could help me with a few queries.

  1. I find it strange that my DE VAT number does not appear anyway on the multi page VAT form for submission only my Tax number ?

  2. Where do you attach the proof of sales to the return?
