hi,
If selling via my own branded and manufactured products through FBA only in the UK store (as a UK Ltd). Does a product need to have a EU Responsible person / authorised representative (AR)?
If selling via FBA the product is available for sale in Northern Ireland so potentially all FBA items sold on amazon.co.uk will need a EU representative - even if not directly offered into the EU.
This is from the Amazon GPSR policy: "The GPSR will not apply in Great Britain (England, Scotland and Wales). It will, however, apply in Northern Ireland, under the Northern Ireland Protocol."
Therefore do all products sold on Amazon UK via FBA need a EU AR?
Thanks!

Amazon says no.
The EU rules certainly say yes. So it’s unclear how Amazon came to this assumption.
thank you. Where have you seen that they say no?
as per the GPSR guidelines…
‘For listings on our UK-based store, you don’t need to submit any information to Amazon. You must, however, submit the required information for listings on our EU-based stores.’
Have you had it confirmed with support? I have opt out from having my uk store listings to be moved and translated into eu stores, have all other marketrplaces switched into holiday mode. But still having FBA products that obviously may be sent to NI. It's all so confusing
There is another thread in which someone has support tell them this, and a mod posted on a thread saying you don't need it as well. That said, it certainly seems like Amazon doesn't know what it's doing with GPSR, as the explanations didn't make sense, and misunderstood the NI protocol.
The example they used of someone buying a plug in an airport then flying to the EU also showed a serious lack in understanding of the difference between selling to a location and moving your own personal property into it.
It's unclear atm if Amazon are about to make a lot of sellers into criminals. All we can do is wait for more information.

Have you made sure your shipping templates don't have EU countries on them?
Many thanks, I also think there is a big misunderstanding of legislation by amazon.
The easiest way to move forward would be to enable NI being exluded from fba orders but that would require amazon to change their own policy.
Will see how it goes. Even solicitors are unable to answer these questions it all depends on how amazon will act moving forwards with regards to NI. Huge amounts of sellers are only selling on uk marketplace. Amazon will have to refer to this at some point before december to clarify their position.
That would be ideal.
A good second choice would be if Amazon just blocked the non compliant products from being ordered to NI.
