I'm facing an issue where my brand ownership request for an ASIN is being blocked due to a discrepancy in trademark classifications. The current rights owner is using a trademark under a Nice Classification that doesn’t match the product category (for example it's for food items, but their trademark is for something else). I hold the correct trademark under the right classification, but Amazon isn't recognizing me as the brand owner.
All my brand applications have been rejected as 'its already enrolled in Brand Registry.' I keep on getting generic replies from brand registry support.
Has anyone dealt with a similar situation? Any advice on resolving this with Amazon Brand Registry would be greatly appreciated.

I'm not clear what's happening.
Are you saying the ASIN is already in BR but the owner has the TM in the wrong category so you want to claim it yourself?
Or that for example there's a seller using the TM "Qwjibo" on Amazon to sell cake toppers and you have registered a TM also for "Qwjibo" but want to sell boxing gloves and Amazon are saying the brand name is already taken?
