CE responsible person

Hello all - does anyone know if Amazon have released the address that needs to be put onto your product when signing up to their CE responsible person service?

Unsure, but I’m interested in any other responses also. I’ve just checked the forms after receiving the email notice today and found that Amazon are asking me to provide an “RP” for 31 brands including Disney, and several others.

I also have one in “completed” - WWE which has the full details of the German company responsible. I didn;t enter those. So should my “RP” responses be the actual brand details? Is that not mis-representing?

Again, this seems to be an exercise in futility.

I have just started looking at this today after receiving the e-mail on tuesday. All our items are bought from manufacturers in the UK but the amazon system does not allow a UK address to be supplied as the responsible person. What are we supposed to do?

After doing some reading up, I’m still not sure how this effects UK sellers selling into the UK only.

The first paragraph reads as follows.

“Responsible Person requirement for CE-marked products
What is coming?
On July 16, 2021, a new EU Regulation on product safety (called the “Market Surveillance Regulation (EU) 2019/1020”) is coming into effect. This new regulation adds the requirement for CE-marked products to have someone present in the European Union acting as the point of contact for product compliance (a “Responsible Person”).”

If you open this and scroll to the very bottom you will see

“Does the EU Market Surveillance Regulation apply in the UK?
The EU Market Surveillance Regulation does not apply in Great Britain (England, Scotland and Wales). It will apply in Northern Ireland, under the Northern Ireland Protocol.”

States very specifically
“As the UK has formally left the EU, UK-based sellers wishing to sell into the EU will need to obtain a Responsible Person.”

So what does this mean? Sounds like, UK based sellers that don’t wish to sell into the EU won’t need to appoint a Responsible Person.

I think the UK and NI are the sticking point, as the UK and NI want some sort of free movement, I think Amazon will still sell into the NI as before and push sellers to having the ‘Responsible Person’ effectively applying the same rule for UK sellers selling only in the UK, whether you sell into EU or not.

Since 1 Jan 2021 the UK has also implemented a ‘Responsible Person’ rule that should be stated on the labeling, is this just the same ?

I understand that you have multiples questions related to EU Responsible Person.

  1. If there is a non CE marked product amongst the requests what should we do?
    The first step is to confirm that your products are subject to CE-marking legislation. Common examples of products that are required to be CE-marked include toys, electronics, personal protective equipment, machinery, construction products, gas appliances, recreational and personal watercraft, pressure vessels, and measuring equipment. All CE-marked products are covered by this rule except for medical devices, explosives for civil uses, and certain lifts and cableway installations.

If you are unsure if the products you sell are required to be CE-marked, we recommend that you reach out to your supplier/legal counsel to investigate further.
If you are sure that your product is non CE market, no actions are required then from your end.

  1. Is there a way to enter the information in one go for all the products from the same brand?

When you access the dashboard, the CE-marked ASINs you sell will be listed. We encourage you to review them and ensure there is a Responsible Person for each ASIN sold by you. Please note that any Responsible Person Information you add for these ASINs is specific for units sold by you.

If your products do not have a Responsible Person, we recommend talking with your upstream suppliers to confirm they are aware of the upcoming changes and to ensure they are taking appropriate actions to appoint a Responsible Person.

If a brand owner appoints a person of responsibility will we still need to complete the process?
If you have reviewed your ASINs in the dashboard and the Responsible Person information is present, and you can confirm it is correct for this brand/ASIN, you do not need to take any further action.
If you believe the brand information is not correct, we recommend that you contact your manufacturer or upstream supplier to confirm the correct information.
If you wish to assign a separate Responsible Person for your units, please follow the steps in the dashboard to guide you through the process of uploading your Responsible Person information.

Anyone come across the situation where you sell CE marked products in the UK but don’t sell into Europe, yet you still have a list of ASIN’s on the Responsible Person dashboard ?

We used to sell into Europe before brexit but no longer do, what is strange is that new products that we have never listed to sell in any of the EU marketplaces are also coming up on the dashboard.

We’ve reached out to SS but they couldn’t help much, just said if you aren’t selling into the EU then you don’t need to appoint a Responsible Person, even though we have advised that dashboard shows that we do. They couldn’t answer why that was or how to get the ASIN’s delisted from it.

Anyone manage to overcome this type of situation?

Has anyone made any progress on this?

I now have over 1000 to do. There does not seem to be an option to add the information for every ASIN in the brand in one go.

It is typical of Amazon that they think I have got time to enter the 10-12 bits of information for all these products.

I am guessing that the answer is no. I had an email from Amazon today requesting timings for a call to discuss this.

I suspect most sellers are ignoring it and Amazon are getting a bit worried.

I’m still getting emails about this, for items that are CE except (and that are no longer sold outside of amazon UK), anyone else the same?
