Account suspension over copyright infringement, please help!

My account was suspended by Amazon due to copyright infringement. I initial listed under an existing Asin which the seller & I was at price struggle as to who will have the buy box. He then deleted the products which I then created my own Asin. The products look similar to a top brand product however it was never listed as a branded product never was the title or description has anything to the popular brand. However we received an intellectual email stating the products has been deleted by Amazon due to infringement, we then delete similar other products. 2 months later while I was away, I received an email that my account has been suspended, fine below the email;

Hello,

Your account has been temporarily deactivated. Your listings have been removed. Funds will not be transferred to you but will stay in your account while we work with you to address this issue. This could take up to 90 days. Please ship any open orders to avoid further impact to your account.

Why is this happening?
We have not received a valid plan of action addressing the infringement issues below.

The root cause of the issue
We received an email on the 12th October that the below Asin Amazon has not received a valid plan of action addressing the infringement issues below.

The actions that you have taken to resolve the issue

  1. We have spent more than 48 hours investigating all our products, we have extensively checked ALL our listing and we have deleted all products that are related to the ASIN we were notified, we also deleted ANY similar products permanently.
  2. All listings, including the ones which received suspected intellectual property violations, have been deleted permanently and will not be reactivated.
  3. We have checked all my remaining inventory and discarded any asin that may be affected.
  4. We have read and understood all Amazon Policies and agreements paying close attention to the ‘Prohibited Seller Activities and Actions Policy and will ensure we strictly abide by them.

The steps that you have taken to prevent the issue going forward

  1. Sourcing: To ensure the authenticity of the products we sell, we are sourcing products only from reputable manufacturers and wholesalers who are authorized by the brand owners ONLY
  2. We have reviewed and will regularly monitor Amazon’s content guidelines for any changes to make sure I am operating within those guidelines.
  3. We are upgrading our listing quality system:
    a. We will be monitoring all listings on a regular basis to ensure that they are always accurate, listed fully with complete information.
    b. We will ensure that all the listings created on Amazon are detailed l page rules and condition guidelines are always being met.
    c. I have updated the product description with additional details so that it is clear what the customer purchasing.
  4. I am monitoring customer returns and complaints on any products, as well as customer reviews on products I offer, as a quality control measure.
  5. We are also upgrading our packaging & Shipping Quality Control, we will make sure all products are thoroughly examined before shipping, to make sure that the product and packaging is up to amazon standard.
  6. I am promptly providing a replacement or refund in response to any customer complaints.
  7. In the future, any products that appear to create a poor customer experience will be withdrawn from inventory immediately.
  8. I am providing excellent customer service and communication in order that each customer has a good shopping experience on Amazon and is satisfied with the products we offer.
  9. We keep to our promise of offering excellent customer service, reply to all customers email within the time frame
  10. We are monitoring our progress on delivery time frames and order manner

We look forward to Amazon’s consideration to help me reinstate my account and we continue to offer our services to customers while we also promote Amazon as a brand.

Unfortunately, you should have taken action prior to having your account suspended over the Suspected Intellectual Property Rights Infringement Complaints.

I have checked your Plan of Action and it doesn’t appear to address the issue properly.

I would advise you to check this example appeal which is specific to Suspected Intellectual Property Rights Infringement Complaints, which may help.

Definitely don’t copy any full sentences but use your own words and talk about your specific situation. The purpose of the example is to show you the proper language, format and style in which you should present your appeal to Amazon:

Before you received the notification that complaints had been filed against you for infringement, were you aware of intellectual property and how it impacts you as a seller on Amazon?

I suggest reading the Intellectual Property Policy for Sellers page as it is extremely relevant to your current situation and will be of aide as you look to address the complaints.

A plan of action needs to be structured, concise, and detailed to the core issues that were found within your account. I suggest following these guidelines from now on:

  1. The root cause of the issue
  • After reviewing your current business model and processes, why do you believe rights owner filed complaints against you?
  • Do you know more about the copyright?
  1. The steps you immediately took to resolve the root cause(s) you identified
  • What have you done, and what did you change within your business model or processes to eliminate those root causes?
  • Where exactly do you check your listing on intellectual property rights, before uploading them?
  1. How you will avoid similar issues from happening again
  • Provide a timeline. Think long-term

The fact that you were unaware of the policy needs to be explicitly stated in your appeal.

You need to build on any possible missteps that led to infringement complaints, and how you are working on improving your business practices to avoid them moving forward.

Choosing not to sell the brand again is a reactive step after your account was deactivated.

  • What processes can you implement today in an effort to audit your entire inventory and commit to total account health for the future?
  • How will you be taking ownership of the concerns detected, and educate every individual involved with your company?

I suggest reviewing the information you have already submitted and focus on the improvements that are necessary for account reinstatement.

Each plan of action should be drafted based on the issues that you are facing. Using someone else’s appeal could not only cause your listing not to be reactivated, but could prevent you from identifying the issues within your process that should be corrected. Therefore be careful when using @Kika ´s example.

The root cause of the issue
We received an email on the 12th October that the below Asin Amazon has not received a valid plan of action addressing the infringement issues below.

The actions that you have taken to resolve the issue

  1. We have spent more than 48 hours investigating all our products, we have extensively checked ALL our listing and we have deleted all products that are related to the ASIN we were notified, we also deleted ANY similar products permanently.
  2. All listings, including the ones which received suspected intellectual property violations, have been deleted permanently and will not be reactivated.
  3. We have checked all my remaining inventory and discarded any asin that may be affected.
  4. We have read and understood all Amazon Policies and agreements paying close attention to the ‘Prohibited Seller Activities and Actions Policy and will ensure we strictly abide by them.

The steps that you have taken to prevent the issue going forward

  1. Sourcing: To ensure the authenticity of the products we sell, we are sourcing products only from reputable manufacturers and wholesalers who are authorized by the brand owners ONLY
  2. We have reviewed and will regularly monitor Amazon’s content guidelines for any changes to make sure I am operating within those guidelines.
  3. We are upgrading our listing quality system:
    a. We will be monitoring all listings on a regular basis to ensure that they are always accurate, listed fully with complete information.
    b. We will ensure that all the listings created on Amazon are detailed l page rules and condition guidelines are always being met.
    c. I have updated the product description with additional details so that it is clear what the customer purchasing.
  4. I am monitoring customer returns and complaints on any products, as well as customer reviews on products I offer, as a quality control measure.
  5. We are also upgrading our packaging & Shipping Quality Control, we will make sure all products are thoroughly examined before shipping, to make sure that the product and packaging is up to amazon standard.
  6. I am promptly providing a replacement or refund in response to any customer complaints.
  7. In the future, any products that appear to create a poor customer experience will be withdrawn from inventory immediately.
  8. I am providing excellent customer service and communication in order that each customer has a good shopping experience on Amazon and is satisfied with the products we offer.
  9. We keep to our promise of offering excellent customer service, reply to all customers email within the time frame
  10. We are monitoring our progress on delivery time frames and order manner

We look forward to Amazon’s consideration to help me reinstate my account and we continue to offer our services to customers while we also promote Amazon as a brand.

I have checked your Plan of Action and it doesn’t appear to address the issue properly.
