I could use some advice on how best to proceed in a tricky situation.
I’m trying to list a product under my intended brand name , which is also the name of my Amazon storefront. However, my listing request was denied with Error 5461, stating that Amazon couldn’t verify that the brand offers car accessories.
At the moment, I haven’t filed a trademark yet, but I plan to register the brand name with the USPTO under Actual Use, once the product is live. The catch is — I’ve learned that if I list the product as Generic now, I won’t be able to switch it to a branded ASIN later, even after the trademark is approved and Brand Registry is complete.
I’m trying to avoid listing it as Generic for that reason, but also can’t move forward with the brand listing until I’m in Brand Registry, which requires a trademark.
Has anyone dealt with this chicken-and-egg situation?
Is it better to file the trademark under Intent to Use now, and then apply for Brand Registry with the serial number?
Will Amazon allow me to list under the proposed brand name once I’m in Brand Registry even if the product hasn’t been sold yet?
Any tips to avoid violating ASIN creation policies while getting the brand recognized?
Would really appreciate any insights or experiences on how to get past this roadblock without compromising future branding.
