Intellectual Property (IP) Infringement Claims

I have had an Intellectual Property (IP) Infringement Claims for over six months now. I have appealed six separate times and all were turned down. Due to this, I have been banned from selling from Amazon.

Now, it is stated that I should provide Proof of product authenticity (invoice, Order ID, licensing agreement, letter of authorization). It must clearly prove that the products do not infringe any intellectual property rights.

This information does not exist, however, because I bought it from a local shop and therefore does not belong to the claimant. It is branded by the local shop.

I have no idea what to do. Does anybody have any advice?

I am sorry to hear that you Seller Account has been suspended. It would be good if you posted here the original suspension notice along with all appeals submitted and any additional communication between you and Amazon regarding the matter.

But normally, you will be asked to provide the proof of authenticity:

(e.g., invoice, Order ID, licensing agreement, letter of authorization)

This should be accompanied with a Plan of Action, similar to this example posted:

If you are unable to provide the proof of authenticity, then your only option will be to delete the entire inventory and then mention it in your appeal.

Retail or Wholesale?
If you’ve only got a retail receipt then the item is ‘technically’ no longer ‘new’.

Where you bought it from does not affect the trademark. If the trademark belongs to another company they have a right to enforce it. The local shop might be using it, and flying under the radar, but you’re putting it online where it’s much easier to find.

If the items really are that brand, have been obtained from an authorised wholesaler, then just provide your invoices and the problem should be resolved.

Unfortunately, the Plan of Action was rejected. The response I received is as follows:

Thank you for your message. We cannot accept your appeal because it does not address the report we received from the rights owner. Please provide the following information so we can process your appeal:

- *Proof of product authenticity (e.g., invoice, Order ID, licensing agreement, letter of authorization). It must clearly prove that your products do not infringe any intellectual property rights. Please send this information, any other documentation, and a list of impacted ASINs to notice-dispute@amazon.com.

  • Greater detail on the root cause(s) of the infringement.

  • Greater detail on the steps you have taken to prevent infringement going forward.

  • Greater detail on why you believe an error has occurred.

Where do I send this information?
Send this information to notice-dispute@amazon.com.

What happens if I do not send the requested information?
If we do not receive the requested information within 17 days of the original suspension notification, your account will remain deactivated.

There is no way I can get the Proof of authenticity, as we know. Without this, I will be unable to re-activate my account

Regardless, I am very grateful for your support and would love to thank you once again. It is a shame, but it is what it is.
